On Friday night St. Louis Police served homeowners Mark and Patricia McCloskey with a search warrant and confiscated their rifle.
The McCloskeys made national headlines when they defended their home from hundreds of BLM protesters who trespassed into their neighborhood to protest at the home of the St. Louis Mayor Lyda Krewson.
Following the visit to their home by St. Louis City Police local gun store Alien Armory Tactical announced they will donate a free AR15 to the McCloskeys after Circuit Attorney Kim Gardner sent police to their house to confiscate their rifle.

I’m sure the McCloskeys can afford another rifle if they want one but this is a nice gesture and great publicity.
It may be interesting how the ATF4473 form get completed. Last I knew a warrant had to be issued based on probable cause and probable cause had to be established by investigation.... Are charges forthcoming? MO Case net does not show any charges filed from my recent look.

Constituents, choose better next election
I have read what this couple have said.
They are getting problems from neighbors, blm and antifa garbage, the city.
They just want to be left alone.
They won’t want this new attention thrown on them.
And although the intentions were altruistic in offering the gun, they will not take it.
If they don’t want to be drawn into the spotlight in the battle for this country, they shouldn’t be forced to.
The greatest strength the left has is that we on the right in nice neighborhoods with nice lives want no grief.
We don’t even want our neighbors to have grief because it could land on our door.
That needs to change in a major way
Great that this was done for them, not great that everybody now knows about it. Still, I’m sure the couple feel better knowing that many Americans support their right to defend their home.
Improper search and seizure?
Surely they’ve rearmed themselves. If they have Left-wing scum breathing down their neck, they’re gonna need some kind of defense (especially being as wealthy as they are).

This is an area where I am in fact an expert.
I have yet to see the legal grounds for the first confiscations.
So what is to prevent the PD from just confiscating the next firearm they obtain, and the one after that, endlessly?
So far as I am aware the couple have NOT been charged with anything.
So the original confiscation appears very suspect and ripe for a “Deprivation of rights under color of law” lawsuit.
Prior threads claim this couple are very wealthy, so why have they not already replaced their confiscated/stolen firearms?
Will they be able to pass a Brady Check to take possession, or have the local LE placed a blocking hold on them?
If so, under what justification sans charges?
Details matter but always seem to be in short supply.

Kim Gardner will come charging into Alien Tactical’s store screaming bloody murder and calling everyone racists.
Or she won’t. Liberal fascists like Gardner lack the courage that made the McCloskeys defend their home.
Gardner will just show up at the store or their house with an army of St. Louis police and call herself a brave victim of racism.

what would be cool is the entire neighborhood facing off afainst the socialist thugs and not letting them in in the first place, like folks did in other parts of the country
Yeah, but this is our way of saying they’re not alone with the thugs, liars, “shits of antifa”... and a democrat mayor so stupid/commie it takes a person’s breath away.
There are NO legal grounds for confiscation because no crime was committed. Law School 101. This is plain and simple disarmament by fiat. Mr. McCloskey is an attorney. Hope he gets motivated and brings a lawsuit. This is plain and simple denial of his 2nd amendment rights.
The more firearms the police unlawfully confiscate from them, the bigger the lawsuit will be. Perhaps they should reconsider harassing this couple and focus on actual criminals, like violent mobs who break down iron gates and terrorize homeowners.
