Pardon Michael Flynn. Time for the President to end this highly politicized prosecution.
Wall Street Journal ^ | July 10, 2020 | WSJ Editorial Board

Posted on 07/11/2020 1:15:57 PM PDT by karpov

The prosecution of former National Security Adviser Michael Flynn has already exposed the bad faith of the FBI and Justice Department in pursuing him even when they knew there was no basis for an investigation. Now federal Judge Emmet Sullivan is continuing the legal torture by appealing an order from a panel of the D.C. Circuit Court of Appeals to drop the charges. President Trump should step in now and end this farce by pardoning Mr. Flynn.

In an honest process, Judge Sullivan would have signed off on dropping charges once prosecutors and the defense agreed there is no case to adjudicate. He refused. Mr. Flynn then sought a writ of mandamus from the D.C. Circuit, and he prevailed in a 2-1 opinion that ordered Judge Sullivan to dismiss the case.

Judge Sullivan is now refusing again by requesting this week an en banc review of the writ by the full D.C. Circuit. Though we don’t know whether the full court will take the appeal, remember that Senate Democrats and Barack Obama packed the D.C. Circuit with liberal judges after ending the judicial filibuster on a partisan Senate vote in 2013.

Judge Sullivan knows that once the court takes the case en banc, the panel opinion is immediately vacated under D.C. Circuit rules. That means the writ ordering him to dismiss vanishes, and the eventual en banc ruling would control. Mr. Flynn’s legal agony would continue for months and perhaps until a Biden Administration takes office.

This is outrageous and continues the politicized nature of this sorry prosecution. The review of the Flynn case ordered by Attorney General Bill Barr found the FBI and Justice Department withheld exculpatory evidence, revised the bureau’s 302 interview forms, and did an end run around normal White House procedures to sandbag Mr. Flynn.

the last 3+ years have exposed him as an embarrassment to anyone with an ounce of credibility.

You cannot be serious.

Being framed by the FBI and the CIA, with the likely collusion of his lawyers, makes Flynn lose credibility?

If the person awaiting the dismissal were named Private Hillary Clinton this Judge would have already shot himself in the back of the head twice, after doing the dog, the cat and any blood relations. It would have been blamed on his right wing guilt.

Hell, the WSJ has been aboard ANYTHING that could get President Trump hurt or fall into a trap. This is one of those things. Let the corrupt judge be forced to dismiss the charges.

I ranted on this subject quite a bit yesterday on another thread. I'm too tired to go through it all again tonight, so I'll just post a link to that thread here:

Judge Sullivan Is Still Trying to Sentence Lt. Gen. Flynn

I'll add a few items to everything I posted there, though:

1. Flynn was working as a lobbyist for foreign interests while he was serving as a senior advisor on national security matters to candidate Donald Trump. Heck, he even had an op-ed piece published in the Washington Post -- the CIA's favorite newspaper for disseminating propaganda -- on behalf of the totalitarian Islamic regime of Turkey ... on ELECTION DAY in 2016. -- Click Here

2. The FBI and CIA were probably among at least a half-dozen foreign intelligence agencies that had access to Flynn's infamous phone conversations with Russian ambassador Kislyak in December 2016. He conducted those calls on his own private cell phone while vacationing in a Third World sh!t-hole (the Dominican Republic).

And he later pleaded guilty to a crime he didn't commit? What kind of a person is this? And how does someone like this end up in a top security role for the most powerful nation in the history of the human race?

***President Trump should step in now and end this farce by pardoning Mr. Flynn***

Unhappily that would brand Gen. Flynn as forever guilty and probably deny him any appointment requiring Senate approval. It also lets a corrupt judicial system off of the hook.

Think of it; even if the full DC Circuit denies Judge Sullivan's attempt to overturn the Constitutional role of judges, Sullivan can appeal to SCOTUS, potentially extending the case for months. This is one of the dirtiest tricks ever pulled by the Left and DS and could drag out the planned destruction of an American military hero ad nauseum.

Here is some context to your remarks.

Flynn, at this point, was merely an advisor, one of many. Most advisors do not drop all their regular work when they become an advisor. President Trump could not have been very concerned with this ad, as he appointed Flynn to the NSA job six weeks later. Why do you think it being election day was important?

So? Flynn knew he was being recorded. He assumed it. It is one of the reasons the phone call was so milk-toast nothing. It only became "infamous" because it was distorted and hidden in order to frame him.

And he later pleaded guilty to a crime he didn't commit? What kind of a person is this? And how does someone like this end up in a top security role for the most powerful nation in the history of the human race?

A member of the human race? Remember, the federal prosecutors get a 98% conviction rate. And that is when they are mostly being ethical. With Flynn it was an all up frame-up, with the most powerful agencies in the word using all their power to destroy him. In addition, they appear to have used their muscle to get Flynn's lawyers to go along with the frame-up, to make sure he did not stray from the cage they had put him in.

The prosecution did not even let him read the transcript of the call! They still have not released the original FBI 302 notes!

The fact, that he was somehow able to overcome this, in the face of all that concentrated power, is very close to miraculous.

He has to be one of the most ethical people in D.C., for the FBI and the CIA to have to go to the lengths they did to frame him.

Concur on abolish! or...

Constitution, Art 3: The Trial of all Crimes, except in Cases of Impeachment; shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed.

DC is not a state. Congress can and should remove jurisdiction for serious crimes by or against public officials away from the DC leftist/ghetto/swamp courts. And take investigation responsibility away from the FBI headquarters clique. Even randomly assigning such cases to US district courts would be better than this.

Good luck getting it through the Senate unless we do what the Ds have promised to do and eliminate the modern filibuster.

Freepers are delusional. If he was appointed to any of these posts, Flynn would go down as the first presidential appointee in history who failed to get a single U.S. senator to vote for his confirmation. Even if everything goes his way and he’s completely cleared, the last 3+ years have exposed him as an embarrassment to anyone with an ounce of credibility.
His career in government is over — unless he was a stooge for the Democrats all along.’

LOL. You’re the one with no credibility on this one. Your willful blindness to the ever mounting evidence of proseuctorial misconduct against Flynn is “delusional.” For some reason you’ve always hated Flynn and can’t let go of your original opinion. I was never a huge Flynn huge due to his questionable lobbying but can see now he has been outrageously assaulted by the coupists. If you want some credibility back you can start by supporting Flynn, Powell and POTUS against the coup.

The unseen hand of Barr and Durham is all over 2019 filings by Sidney Powell, Flynn’s crackerjack atty.

<><> These are the infamous altered 302s that we have all been hearing about for the past year that nobody has managed to produce.

<><> By having the evidence introduced in the Flynn case, the argument that Barr’s investigation is simply revenge by President Trump is shot to pieces.

<><> And who better than Sidney Powel to handle the gutting of Andrew Weissmann? She has literally written the book on his corrupt tactics: “Licensed to Lie.”

<><> Powell’s efforts in the Flynn case are only tangentially about exonerating and bringing justice to General Flynn.

<><> In a much more profound sense what she is doing as an integral part of the effort to expose the criminal conspiracy to subvert the office of the then-sitting Presidency of the United States....Barack Obama.

<><> This seditious Obama conspiracy is in fact an unprecedented attempted coup d’etat.

<><> Barr and Durham — and now with the help of Sidney Powell — are without question handling the prosecution of the most important criminal case in the history of the United States.

<><> In this construction, General Michael Flynn is fighting the last and indisputably most important battle of his distinguished military career: The battle to save our Republic. (SOURCE: CFP blogger)

THE FLYNN DEBACLE WAS A NEW LOW FOR POWER-CRAZY DEMOCRAPS

They cant get votes based on their accomplishments, political acumen or voter respect.

They have to resort to law-breaking and other con games.

The big-mouth phony cowardly Dems are social predators and sociopaths with no conscience and in a perfect world, would be hunted down and caged for the protection of humanity and society.

Defending the Constitution and serving the American people isn’t in it for the democrats. Democraps are totally amoral; they worship power and money only.

The last time I had a running conversation on FR threads with you over a Trump appointee was a few years ago. You said the same damn things at the time when I allegedly had a "willful blindness" in my criticism of that person.

Do you remember?

The guy's name was John Bolton.

With that kind of track record you might want to be a little more circumspect before you reflexively defend someone associated with this administration.

LOL. A lot of people were wrong about Bolton. It’s easy to be an armchair isolationist and take a contrarian position to any US involvement in the world. It’s also easy to take shots at supporters of POTUS from that armchair safe in the knowledge that no FBI swat team will be breaking down your door and arresting your children.

There’s no equivelence to anything Flynn has done to what the Deep State did to him. Flynn’s crime is supporting POTUS. We’re all guilty of that “crime.” Think about that before you cast stones at Flynn.

I don’t trust anyone who has spent decades of his career in government — and that includes Michael Flynn, too.

Trump has filled his administration with disloyal, opportunistic, globalist A-holes. That description would apply to almost every person in his administration who has worn a military uniform, too.

I wish Flynn well. I hope he successfully sues every pr!ck in the DOJ/FBI for a trillion dollars. I also hope I never hear his name again after this is all over.

P.S. — There was a time here on FR when it wasn’t easy to be an “armchair isolationist.” Go back and read some of the threads here from the mid-2000s, and notice how many Freepers were suspended and banished at that time because they refused to accept the globalist war-mongering bullsh!t that was accepted as the Republican Party line back then.

I disagree with you. He’s a man who was convinced that the system generally worked, because he never had the experience where the system turned against him, until he ended up falsely charged.

I can’t think of a better man than a man, who has deep intelligence experience and now knows the system is corrupt.
