One Man’s Supreme Court [Justice Roberts]

The Supreme Court ruled 5-4 Monday that a state can’t even require abortion providers to have admitting privileges at a hospital. And the logic of the concurring opinion from Chief Justice John Roberts, who provided the fifth vote, suggests not even de minimis regulation of abortion will survive his Court’s scrutiny.

Here’s the stunner: Four years ago a different Court majority overturned a similar Texas statute, with then Justice Anthony Kennedy joining the four liberals. Chief Justice Roberts dissented in that case. Yet on Monday the Chief joined the liberals, citing his duty to follow precedent.

As the dissenters point out, the Chief also ignores the Court’s recent precedents on standing law, or the ability to show harm. The Court’s precedents require that a plaintiff have an injury due to the law or regulation at hand. In this case, the abortion providers aren’t hurt because there is no constitutional right to perform an abortion and Louisiana requires admitting privileges for many other medical procedures in case something goes wrong.

Russo continues a dismaying string of rulings by the Chief Justice—less due to their result than their reasoning. He seems to think he has to protect the Court from Democratic threats to undermine its legitimacy. But in the process he is resorting to logic that looks designed to achieve political results.

On ObamaCare, he defined the insurance mandate as a tax. On the Census, he said the government’s logic was “pretextual.” On immigration this month, he said an Obama order was illegal but he overturned President Trump’s repeal order on procedural grounds. Now he relies on an abortion precedent he dissented from by rewriting that precedent.

All of these look like a Justice searching for a legal port, any port, to justify his rulings in a political storm.

Apparently Robert's fear of the Democrats compel him to rule in support of their agenda. Only justices appointed by Republican presidents betray conservatives. Justices appointed by Democrats never stray from rulings that support the Democrat agenda.

I often wonder why the Dem presidents can get it right, but not the Republican presidents. Even Reagan got it wrong.

Advisors for Republican presidents need to study this and help the Republican presidents get it right.

Drugs for epilepsy can mess up the minds of some, at least, people. i was on Dilantin and Tranxene for 16 years and was essentially retarded and getting dumber until I finally took myself off. No more seizures. It took me a few more years for the fog to dissipate. I would never trust a man with important decisions who takes any of these drugs.

The problem is the inherent power of the position. Democrats and the left seek power as the be all and end all of their existence. That does not change when they get that power. Republicans have other priorities, such as justice and truth. When a man is put in a position of vast power who is not power oriented he is strongly motivated change and often does. It is like thinking of all the wise moves one would make if one won a hundred million dollar lottery, then winning it. All that rational and wise thinking is then for nought. All of a sudden- I CAN DO THINGS NOW!!!

In 2016 Roberts dissented in a Texas ruling on an almost identical law.
Same case in Louisiana he joins four liberal justices in an opposite decision.
Dems and fake news remain silent, why are they not celebrating?

You notice the Dems don’t have this problem? Republican put moderates like Kennedy and O’Connor and, now apparently, Roberts on the Court, and outright liberals like Souter, but Democratic Presidents bat .1000 in putting leftists on the Supreme Court.

Good for you and will be praying for you. Meanwhile, the country puts up with an epileptic chief justice whose decisions contradict his previous ones. Of two minds does not do this clown justice. He was also infertile, having to adopt children and even that was a problem. This supposedly "conservative" justice has no idea what he is doing. Hey Hugh Hewitt, have anything to say about your favorite justice?

The clown that was the "prophet" of Islam was also an epileptic. His "revelations" came after his epileptic episodes, asking for a cloth to gird himself, repeating gibberish that culminated in a "holy" book. The man was an epileptic murderer, thief, rapist and child abuser, all the while claiming to be a "prophet" of a moon god named Allah. Heaven help us through this time. Please, please Lord.

Democrats fight to the death to block confirmation of conservatives on the court. It really started when Teddy Kennedy was able to lead the filibuster block Reagan’s appointment of conservative Robert Bork. So we got “moderate” Anthony Kennedy, the swing vote in many important 5 to 4 cases. Republicans never put up a fight against liberal appointees. For instance, 46 Republicans voted to confirm Ruth Bader Ginsburg. Republican presidents have realized that they could not get conservatives confirmed to they appointed liberal to moderates. Trump is the exception now that the filibuster for Supreme Court Justices no longer exists. Harry Reid killed it. Let’s pray that Trump is reelected and that we keep the Senate.

I heard Rush Monday say that the reason that the liberals are not celebrating is that this case increases awareness that the Supreme Court is a critical election issue. They are afraid that this ruling will motivate the conservative base and help reelect Trump and keep the Senate
