An 88-year-old liquor store owner was arrested for shooting a robbery suspect. Owner May Boyce was charged with aggravated assault with a deadly weapon after a man allegedly lunged at her while trying to steal from her.
I did what I had to do, and I hope word gets out on the street that Im fed up and Im not taking it anymore, May Boyce told the New York Post after she was released on $10,000 bond. Youve got to stick up for yourself sometimes.
Boyce said that she has been robbed multiple times while working at her shop, Murfreesboro Road Liquor and Wines, but said the past four years have been especially bad.
This was in the blue city of Nashville, Tennessee.
The five-foot-three, 115-pound widow was at work on June 16 when two men came into the store, the New York Post reported.
One of the men walked behind the counter and began helping himself to bottles, while the second man approached her in a manner that she knew indicated he was planning to steal from her, The Charlotte Observer reported.
Undeterred, Boyce grabbed the .38 Smith & Wesson snub-nose revolver that had belonged to her mother and placed the gun on the counter, according to the New York Post.
While they were grabbing me some liquor, she confronted them and Ramon Fisher lunged at her.
She believed he was under the influence of cocaine and alcohol. As he ran out, she aimed at the ground and fired.
Ms. Boyce stated that she pointed the gun towards the ground, in the victims direction, and fired once, police said in the arrest affidavit, according to The Charlotte Observer. The victim yelled out that he had been shot and fell into a stack of bottles.
HE TOOK BACK HIS CONFESSION
He ended up in the hospital and confessed, but later recanted. Now hes trying to say there was a third person, but there is no evidence there was a third person.
While she doesnt regret defending herself, she wont have a gun for at least a couple of years. As she said, might be dead by then.
Ms. Boyce said she only fired to frighten Fisher and the other criminal.
There are no available photos of the perps because the media protects them. There is no word if they were arrested yet or will be arrested.
Don’t worry, people will do nothing about this.
Aim a bit higher next time, Granny
and don’t wait til his back is to ya
Have the trial tomorrow and let the jury decide her fate. She will be home for supper.
NOT GUILTY!
The perp was a wee bit darker than obozo, I would guess.
The title is purposefully misleading.
she fired at him as he was running out.
Do I care? no.
But folks should read articles to get exactly what happened as papers just want to sell.
Can’t shoot someone fleeing.
sucks but it’s the law.
and NO i would not find her guilty. But i probably wouldn’t survive jury selection
“He turned away to grab something from his belt and I fired, and kept firing until he stopped moving.” - That’s how that could have been a happy ending. Instead ‘warning shot at the ground’, I’d absolutely wish to be on her jury, no conviction would take place.
That was the time to fire.
What she did is outrageous!
The rules of engagement are now shoot, shovel and shut up. She should know that.
As early and as often as possible.
Her first mistake was talking to the papers. The only thing from her should have been, I feared for my life and I want a lawyer.
The “no pictures or descriptions of the perps” is a description of the perps. Hey, media! We know how to read between the lines.
Yup if all these state officials are going to come down on law abiding citizens who defend themselves against the criminals they’re allowing to run around on the streets or even releasing from jail my guess is don’t call the cops hide all video cell phones and get your nephews to come get the body.
I once got called for an open murder trial. I fully expected to be rejected when the defense attorney had his chance to question me.
However, the dumb ass didn't ask me I'd ever been employed by the Police.
I had, for the agency investigating the crime.
He also didn't ask if I knew any of the people involved with the case.
The idiot didn't recognize me. He'd been my ex-wife's attorney who screwed me over big time.
Turns out I also knew the lead detective working the case.
In spite of that I actually listened to both sides and rendered a fair judgment.
“We know how to read between the lines.”
I would add one more thing.
I think permits to carry or to buy are definitely unconstitutional. But I do think to buy any firearm one should be required to present a certificate that shows completion of a class explaining the self defense laws in that particular state.
Of course this would not have helped her in this case because she inherited the revolver.
She probably never knew that shooting a fleeing robber is a no-no in every state, with the possible exception of TX.
Even though I would never vote to convict her, I suspect that she will be convicted because of the way the laws are written.
I hope if she is the judge just puts her on probation and fines her one dollar.
"My reaction time just isn't what it used to be." <<-- should be her response
“Cant shoot someone fleeing.”
