The first occurred before the House Judiciary Committee, where Andrew Zelinksy, a career prosecutor currently working at the Justice Department, took the extraordinary step of testifying about political interference in criminal cases from “the highest levels of the Department,” namely by Attorney General William Barr. Zelinsky described career officials being overridden and departmental sentencing practices violated, all to give “a break” to President Trump’s close associate Roger Stone, who has been convicted of conduct that threatened our country’s national security.

Circuit, issued an opinion in the prosecution of former Trump national security adviser Michael Flynn. Barr intervened in that case to give a break to yet another close Trump associate, by filing a highly unusual motion to dismiss the case even though Flynn had already twice pleaded guilty. Under the governing federal rules, such a dismissal requires “leave of court,” and the judge overseeing Flynn’s case, Emmet Sullivan, was preparing to hold a hearing on the government’s request. But in an unprecedented move, the Appeals Court stepped in before Sullivan had even considered the government’s motion and ordered him to grant it.

Newspaper. I laugh at people who still get propaganda from that fold of paper. Anything written in it is outdated and likely inaccurate.
Now we need to put an end to the national news readers. I personally quit watching that garbage years ago. Even Fox has the stench of cnn now.

in a nation of 350 million (lus) and with half of them being whack-jobs... how many chess pieces would need to be taken off the board, to park the ship of deep state at the bottom of the Marianas trench?

Someplace where there is NO HOPE EVER of coming back... gitmo or some other extra territorial blacksite “resort”... 5,000 per state? 250 K or more... looking for an order of magnitude...

This is pure propaganda at its worse. This is written for those who have not read the decision and will not. Those people are expected to follow blindly these so called experts. They may be, on paper, experts, but the are the worst sort of political hacks who are willing to put their names to this tripe.

Consider this example:

Laurence H. Tribe: Judge Sullivan must reject Barr’s usurpation of judicial power. The appellate court’s highly unusual and legally flawed opinion rests on an account of the Justice Department that blinks reality. Without any appreciation of its ironic timing, given Zelinksy’s simultaneous testimony, the court hung its decision on “the presumption of regularity” that courts typically afford to the Justice Department’s “exercise of its prosecutorial discretion,” including its decisions to abandon ongoing prosecutions. But presumptions are just that: starting premises that can and should be set aside when reality points the other way. And in Flynn’s case, just as in Stone’s, there is ample evidence that the department’s conduct is anything but regular.

I doubt that Tribe read the decision and tasked one of his minions to write this nonsense. The actual decision, unlike this nonsense, is brilliantly written, carefully argued and solidly supported by the Constitution, the law, and the facts. The only thing worse than Tribe's feeble diatribe is the dissenting opinion by Judge Wilkins. It's not even worth bird cage lining.

Of course, no one, especially the press, have bothered to read the decision or the many briefs filed in support and in opposition to the motion to grant a writ of mandamus. This piece is intended to convince people not to do so now, but to rely on their observations and judgment. This could give cover for someone to ask for an en banc review, but my thoughts are that this is a parting shot. Put this out there and walk away from this flaming dumpster full of crap. They can use this for ammunition to advance the cry for the impeachment of the Attorney General and work this stuff into campaign advertising. That's all they've got lef.

Their nightmare would be a request to convene the en banc Circuit Court which may prompt more people to read what is on the record, including the press, the politicans, and the Judges sitting on this circuit. That will be ugly and I am convinced that the Democrats understand this. I don't believe that there will be an en banc hearing and this article will be the final shot.

Sadly, this is the point of view the majority of the American people are hearing from the mainstream media. The media is telling them Flynn is a criminal who Barr and Trump are corrupting the legal system to get off. Nothing about the criminal behavior, withholding of evidence, threatening of Flynn’s son, overt and vocal bias of the judge, malpractice by Flynn’s lawyers who were tight with the prosecutors, lying by the prosecutors, rewriting of the investigative agent interview report to give the impression Flynn was lying.

The country is dying because the people responsible for maintaining the rule of law (attorneys, politicians, judges, and investigators) have corrupted it.

They have spoken and all their party minions will now echo the same points until the election.

The Flynn case makes justice too difficult to attain in this country. He was set up and attacked by the courts.

Plus the fact that it’s been 4 years and no indictments against those who sought to overthrow the country.

I don’t think errors were committed, and the writer is attempting to deceive the public. The opinion correctly points out that the parties are no longer in conflict, both agree that prosecution on the charge does not serve justice. Therefore, the Judge cannot continue the case and he cannot do what he has attempted to do, become the prosecutor. The Court ordered him to dismiss the case and to ignore this order is an insult to the defendant and to the government, both of whom are experiencing irreperable harm if this continues. The question now is can a District Judge usurp the Constitutional Powers of the Executive? He cannot and he has been ordered to desist.

Funny that there’s no mention of withholding exculpatory evidence, which is a) prosecutorial misconduct, b) far, far too common to be accidental or coincidental, and c) for my money, ought to result in lifetime loss of legal credential, and serious jail time.

This is systematic denial of our civil rights, and must not be tolerated, or ignored.

Yes, but Globe readers DEMAND to read propaganda.

Leftist articles such as this always omit the critical information: Flynn was set up by the FBI in a perjury trap. There was no legal predicate to justify the FBI agents' questioning of Flynn. The FBI was not investigating a crime. The FBI already had the transcript of the Flynn-Kislyak conversation. The only reason for FBI agents to ask whether or not Flynn discussed sanctions with Kislyak was to induce Flynn to say something that was contradicted in that conversation, so they could publicly destroy Flynn's career and hurt Trump.

He did, and they did. Their scheme worked.

This was an American version of "Show me the man, and I'll show you the crime."

Leftists never mention that Flynn had to sell his house to pay his huge legal fees. They never mention that in return for Flynn's guilty pleas, the DOJ agreed not to prosecute Flynn's son for violation of the widely-ignored Foreign Agent Registration Act.

Should Flynn have simply admitted that he did discuss sanctions in the Kislyak conversation? Maybe so, as the discussion was perfectly appropriate for an incoming Director of National Intelligence. Or maybe he should have refused to answer, since the FBI had no need to know. In any case, lying to the FBI is not necessarily a crime. Telling an FBI agent that the sun sets in the east will not land you in jail, since the "lie" is not materially relevant to a crime. Neither was anything Flynn said.

The Court of Appeals was very clear that there was no political influence. The DOJ laid out the facts of the corrupt prosecution of Flynn, and the COA agreed; in addition to all the constitutional bases for the relief requested.
