Yes, and NO. The power of the purse, the power to allocate the money, to open the purse and distribute the money, belongs to Congress. No additional money was allocated by the Executive Branch. The power of the purse was not abrogated or interfered with, in any way.

The money had been already transferred TO the Executive Branch, of which the Defense Department is part. The Executive Branch then took the money they had been allocated, and applied it to the purpose the Executive determined to be the most important and necessary. The purpose of the Defense Department is to defend the country, in this case the borders of the continental United States. Building the Wall is the action serving that purpose. That issue is not and has never been disputed.

What is happening is that the Appeals Court, the Judicial Branch, is violating the constitutional separation of powers, either with their ruling, which abrogates the Executive’s duty and responsibility to make decisions that defend the country, or by falsely granting Congress, the purse holders, with the specific power and responsibility of earmarking the use of or denying such use of the money for a given purpose. That is the Executive’s decision, ultimately and finally.

We are being lied to by leftist jurists, as usual.

By definition, Tax monies that are used to build the physical barrier between nations has to be “military money”.

The “power of the purse” is uniquely associated with the House of Representatives (1.7.1).

And speaking of power, the corrupt 9th Circuit Court wrongly ignores that citizen taxpayers have not only always had the express constitutional power to elect federal representatives, now also to elect senators, and effectively ordered Congress to build the wall when they elected PDJT.

Send "Orange Man Bad" federal and state government Democrats and RINOs home in November!

Supporting PDJT with new patriot federal and state government leaders that will promise to fully support his already excellent work for MAGA and stopping SARS-CoV-2 will effectively give fast-working Trump a "third term" in office imo.

So the military cannot be used to defend the border? Building a wall is a humane thing to do. I’m all for setting up machine guns on sensors to cut any illegal in half as they trying to invade. It would only take a couple of casualties and the invasion would stop. Far fewer wetbacks would die that way than they currently do at the hands of coyotes and nature.

9th Circuit has no jurisdiction in this case. If Congress doesn’t like it, it is up to them to dispute the constitutionality.

A federal court has no jurisdiction. Trump declared an emergency, and that allows him to operate outside the codified law to deal with the emergency. It is not subject to judicial review. The declaration of emergency is literally him declaring he will be operating outside of legal structure as commander in chief.

If he oversteps in exercising his presidential power to deal with the emergency, the Constitutional remedy is that Congress can convene, pass legislation overturning his Emergency. If they do it with 2/3s, they check his move. If he still refuses, they can impeach and remove him.

Judges have no role.
