“How can a judge file an appeal in a case he is not party to...”
He can’t, this is over.

I see your point, but it wouldn’t be the case itself being appealed - it would be the Writ directed against him. I imagine that would give him standing

I’d post the comments from DUmp but it would amount to a continuous bleep.

Wait until they learn that General Flynn can now sue the FBI for the 6.7 million dollars he spent fighting the charges PLUS additional damages because they lost qualified immunity due to the charges not being filed "in good faith."
That'll send 'em swirling down the crapper.

The Circuit Court is covering for the District Court judge who made a lot of improper decisions while trying to build a case against dismissing the case. By doing this, the judge is saved from a detailed review of his biased and improper decisions down the road.

there were new notes produced by the FBI - Struyk 2017
...
Yes, but were those notes submitted to the appeals court or only Sullivan?

No, it would not give him standing. He has no personal interest in the case. To assert any kind of standing would make him a de facto party to a case he is presiding over.
To: gwjack
This does not stop at just the Flynn suit being tossed out.
Justice Dept (if we still can trust them) and The Right needs to dig into how the case was brought about.
Flynn and his attorney(s) need to make REAL people pay for the travesty of justice.
