Sen. Lindsey Graham said Saturday he will not take up President Trump's nomination for a new U.S. attorney for Manhattan unless New York's Democratic senators sign off.
Graham, a Republican from South Carolina who chairs the Senate Judiciary Committee, said he will honor the "blue slip" tradition and require the consent of home state senators to proceed -- in this case, Chuck Schumer and Kirsten Gillibrand.
Graham's statement signals an uphill climb for Trump to get a new Senate-confirmed federal prosecutor in one of the nations most high-profile districts. It comes hours after Attorney General Bill Barr made a Friday night announcement that Geoffrey Berman, the current U.S. attorney for the Southern District of New York, is stepping down.

Schumer is asking Clayton to remove his name as a nominee....which means this is still active. As far as the blue slips...let’s take a wait and see.
Conservatives should be able to organize beyond the primary to stymie people like Lindsey. Otherwise we will not win. Sometimes it is good for a senator like Lindsey to lose in the general, if we have the numbers elsewhere. Otherwise we will end up with Paul Ryans who do the work of democrats behind the scenes.
Linda, I have a suggestion as to where you can place those blue slips.
Barr can’t fire. That’s what the President does. Half of all this is fake news. Wait a couple days. Graham is doing fine.
No matter what Graham thinks or says, the “blue slip” is not a deciding factor in the nomination of a circuit judge. It is an opinion by the senate officers of that state, that’s all. Graham can continue the confirmation process without their yea or nay, but chooses to wait until the signoff, either yea or nay, by Schumer and Gillibrand. It is the process the senate has used for over a century.
From the article:
“Sen. Lindsey Graham said Saturday he will not take up President Trump’s nomination for a new U.S. attorney for Manhattan unless New York’s Democratic senators sign off.”
So, if he is just proceeding with the process to get it done, that’s one thing. He didn’t say he would disqualify or refuse to proceed if they said nay, just that they had to sign off on the blue sheet yea or nay before he would proceed. Now, if they say nay, and he does not proceed for that reason, then he’s wrong as their votes do not constitute a 1/3 plus size of the senate vote and that’s from Article 2 of the Constitution.
There have been three judges in history that were confirmed over the objections of a home-state senator:
1989: Judge Vaughn Walker, nominated by President George H.W. Bush, was confirmed to the U.S. District Court for the Northern District of California over the objection of Democratic Senator Alan Cranston.
1983: Judge John Vukasin, nominated by President Reagan, was confirmed to the U.S. District Court for the Northern District of California over the objection of Democratic Senator Alan Cranston.
1936: Judge Edwin Holmes, nominated by President Roosevelt, was confirmed to the U.S. Court of Appeals for the Fifth Circuit over the objection of Democratic Senator Theodore Bilbo.
So the process has to continue no matter what they send in on the blue slip, yea or nay. If it doesn’t, Graham can be in real trouble cause what happens if they are the only two that say nay? Two senators are going to hold up the entire rest of the senate? I don’t think so. This article is dirt, not truth. And I’m really disappointed that Fox is misleading people this way without evidence. I expect the liberal media to use, and have used, this type of trash. Shame on you FOX.
rwood
wow
pass the buck to democrats for your decision
we really need more like Lindsey
/s
You know that he won’t. That goes without saying. Graham has not and never has for Constitutional Government. He is the god of South Carolina. He is adored, loved, worshiped, and held in high esteem by the voters of South Carolina. Proof of that is his reelection as every election cycle.
Why? The voters of South Carolina will just elect some one just like him in his place.
Sen. Grassley ignored the blue-slip courtesy when he was Judiciary chair. Sen. Grassley will return to Judiciary chair, assuming GOP keeps Senate control next Congress.
a tragic mistake letting Schumer and Killabrand choose or veto the nominee. tragic and totally unnecessary
Never.
Graham must be defeated
A thousand enemies will not do half the damage that one “friend” like Lindsey Graham will.
A Hannity interview of Graham is a cross between a love fest and a Graham press scrum.
This is the sort of crap that makes us despise Washington.
Can you imagine the scenario where the situation could be reversed?
Can you hear Schumer saying there would be no nomination without McDonnell’s approval????
Lindsay Graham’s is complicit in whatever illegality that Schumer and the Democrats are perpetuating. It makes Z * E * R * O sense for the Senators from New York to determine who the United States Attorney is in the SDNY.
WTF is wrong with Graham? This is the kind of crap that will turn America into a one party country.
Did he actually say this on camera where I can see it. It sounds a little premature for him to get involved before the nomination has been officially presented.
