Ex-judge says push to dismiss Flynn case is abuse of power

WASHINGTON -- A former federal judge appointed to review the Justice Department’s motion to dismiss criminal charges against President Donald Trump’s former national security adviser Michael Flynn said there was evidence of a “gross abuse” of prosecutorial power and that the request should be denied.

Former U.S. District Judge John Gleeson said in a filing Wednesday that the government “has engaged in highly irregular conduct to benefit a political ally of the President.” He urged the judge handling the case to deny the motion and argued that Flynn had committed perjury.

Gleeson slammed the Justice Department’s motion to dismiss the case, saying the arguments from prosecutors were “riddled” with legal errors.

“The Government’s ostensible grounds for seeking dismissal are conclusively disproven by its own briefs filed earlier in this very proceeding,” Gleeson wrote. “They contradict and ignore this Court’s prior orders, which constitute law of the case. They are riddled with inexplicable and elementary errors of law and fact. And they depart from positions that the Government has taken in other cases.”

Sullivan also asked Gleeson to explore whether he should hold Flynn in “criminal contempt for perjury.”

In the filing, Gleeson said it was clear that Flynn had committed perjury and should be punished but that it should be a factor considered at his sentencing, as opposed to additional charges being brought against him.

“This approach - rather than a separate prosecution for perjury or contempt - aligns with the Court’s intent to treat this case, and this Defendant, in the same way it would any other,” Gleeson wrote.

“another damned misleading, lying headline ”

Yes. Nothing surprising about Gleeson’s opinion as it was expected. As far as I am concerned it is a total set up and stinks worse than rotten fish!
According to the following:

“There is also no merit to Mr. Flynn’s implication (Pet. 29-30) that the district court’s appointment of retired Judge Gleeson suggests he will rule against Mr. Flynn.”https://www.lawfareblog.com/judge-sullivan-submits-brief-dc-circuit-flynn-case

“Judge Sullivan appoints retired Judge John Gleeson as amicus “to present arguments in opposition to the govt’s motion to dismiss”

I emailed a letter to the Associated Press this morning about this article and they have somewhat edited their earlier version... but it is still very misleading. Read the first paragraph in this version and then read the first paragraph I pasted below as well as my letter to their editors.

Ex-judge says push to dismiss Flynn case is ‘abuse of power’

WASHINGTON (AP) — A former federal judge appointed to review the Justice Department’s motion to dismiss criminal charges against ex-national security Michael Flynn has found that the government’s request should be denied because there is “clear evidence of a gross abuse of prosecutorial power.”

The above paragraph written in this story is so misleading it can only be characterized as a series of bold-faced lies! Retired Judge Gleeson WAS NOT “appointed” to “review” the Justice department’s motion to dismiss, he was invited to make an amicus filing by embattled Judge Emmett Sullivan to make Sullivan’s argument the case should not be dismissed... which Gleeson had already made in a Washington Post op-ed several weeks ago. Judge Sullivan has no authority to “appoint” a former officer of the court to participate in the proceedings and part of the reason a Writ of Mandamus against Judge Sullivan was filed with the Court of Appeals for the DC Circuit in the matter.

Secondly, and contrary to the dishonest assertion made by these writers, there was no “finding” by Gleeson in this matter, only the opinion of a former judge who has no standing in the case whatsoever according to legal precedent. Claiming that an “appointed” judge has “found” something to be true in a “review” of the case against Lieutenant General Michael Flynn is journalistic malpractice and exposes the bias of not only these so-called journalists, but also Associated press for allowing it to be published.

Thirdly, nowhere in this Associated press article is any mention of the facts of the case... which include the government’s concealment of Brady evidence, acknowledgement that the Justice Department had already determined Flynn had done nothing wrong and shouldn’t be under investigation in the first place, discovered notes revealing the FBI was trying to “get’ Michael Flynn to lie so they could charge him or “get him fired”, the missing original FD302... and no mention of the emails between Peter Strzok and Lisa Page as they discussed altering the FD-302 they eventually presented the court. This is called prosecutorial misconduct and should be cause for Strzok, Page and others to be thrown in jail for evidence tampering and obstruction of justice.

Of course, this exhibition of dishonest, partisan bias has already been picked up by several media outlets throughout the country and will be heralded by all the usual suspects in the relentless effort to to smear the Justice Department and the President. That is what you people do, you obviously have no interest in the truth.

President Trump is absolutely right, the media is the enemy of the people. I find you disgusting!

Wasn’t he called upon to do exactly that by judge Emmet Sullivan?

Judge Gleeson would appear to know abuse when he sees it; after all, he is a victim of self-abuse.
