I can’t believe you posted this. There’s millions of law enforcement across the country and some of you want perfection. How is that possible? How could any normal minded person be kicking the police at this point?

It happens too much on this board. And you guys might as well run with the leftists

“the old man was trying to tap them them with his phone like an agitation technique”

Huh?

You mean like touch them with his phone is a “technique”?

Saw this. The worst part is they all (cops) walked by him while he was on the ground bleeding.

(Two military members did stop to check on him.)

This incident did absolutely nothing to alleviate the current tensions with police.

Some police mishandled that situation. Common sense says that the old man was feeble as shown by his manner of walking, posture and movements. The police directly involved should have taken hold of his arms, moved him off to the side and restrained him if necessary (hands in front for an old person). If a person like that resists with enough strength, escalate with it. Should be second nature with training.

That said, in my opinion, if the old man was helping the subversive commies, he’s a creep.

Exactly.

“On June 3, before the incident in the video, Gugino wrote on Twitter, “The cops should not have clubs. And should not be in riot gear. The National Guard should arrest the police.” A GoFundMe site has been established to help Gugino.”

Why couldn’t the cops just have given him a “harsh talking to?”

He obstructed a moving column and had his hand within 6 inches of the cop’s gun.

I would have gave him a little shove too.

57 cops from that unit agree. And they just quit.

I don't have a dog in this fight. But I would strongly suspect that the police were baited.I know that they are being set up and used by their superiors, the politicians. What can the Police do to counteract this other than hoping that I am not the next victim? I don't know. But they are smart. They will figure out something. They had better. Their asses depend on it.

Maybe the could have jus written him a strongly worded letter.

He was moving towards them. He was told to move several times.

Screw him.

Don’t care. He was an asshole that approached a line of riot cops and tried to protect the enemy. He touched an officer’s weapon.

He is the enemy. I no longer make the mistake of thinking being elderly means you are special. Think of the biggest young sphincter out there today. Someday they will be elderly and they will be the same person.
In 1969 he was probably out there burning his draft card and throwing rocks at the guard.

Screw him.

“If not for the video, all we would know is “one person was injured when he tripped and fell”.

Which also happens to be exactly what happened.

I’m feeble and same age. If you pushed me, I would fall exactly like he did.

Dumbass was standing between the cops and a riot. Might as well have been playing in traffic. Watch him go backward after a light touch to get him out of the wat - a World Cup class set up.

Negligence

Definition
A failure to behave with the level of care that someone of ordinary prudence would have exercised under the same circumstances. The behavior usually consists of actions, but can also consist of omissions when there is some duty to act (e.g., a duty to help victims of one’s previous conduct).

Overview
Primary factors to consider in ascertaining whether the person’s conduct lacks reasonable care are the foreseeable likelihood that the person’s conduct will result in harm, the foreseeable severity of any harm that may ensue, and the burden of precautions to eliminate or reduce the risk of harm. See Restatement (Third) of Torts: Liability for Physical Harm § 3 (P.F.D. No. 1, 2005). Negligent conduct may consist of either an act, or an omission to act when there is a duty to do so. See Restatement (Second) of Torts § 282 (1965).
Four elements are required to establish a prima facie case of negligence:
the existence of a legal duty that the defendant owed to the plaintiff
defendant’s breach of that duty
plaintiff’s sufferance of an injury
proof that defendant’s breach caused the injury (typically defined through proximate cause)
Determining a Breach
When determining how whether the defendant has breached a duty, courts will usually use the Hand Formula (created by Judge Learned Hand in United States v. Carroll Towing):
If B < PL, then there will be negligence liability for the party with the burden of taking precautions
B=burden of taking precautions
P=probability of loss
L=gravity of loss (gravity of the personal loss, not social loss)
If the burden of taking such precautions is less than the probability of injury multiplied by the gravity of any resulting injury, then the party with the burden of taking precautions will have some amount of liability

I couldn’t figure out what he was doing with his right hand, or even tell what the object was, but no one really reacted until he reached out to the one officer’s gun.

I think everyone was surprised that he took a tumble, but the supervisor driving the line, toward the end of the clip said they had an EMT on scene (assume that was the guard troop who started to treat the old guy). They idea that you can walk up to a skirmish line, and reach toward a cop’s gun and just be left alone is crazy.

I’ve watched this several times- trying to find an excuse for the actions of these officers. I expected there was pandemonium and rioting given the way they were moving, but when the camera pans around, there’s hardly anyone- just the one young guy they apparently arrested.

So my question is what was the cause of the old guy being shoved by the two cops? It wasn’t a bad scene like New York or Minneapolis.

Now the entire 57 member aquad has resigned because they suspended the two without pay pending investigation.

Ugly.
