Lynching is still not a federal crime in the United States, despite nearly 200 attempts by lawmakers to make it so.
Now, as the nation grapples with the death of George Floyd, emotional debate broke out on the Senate floor as one lawmaker stood in the way of allowing the historic passage of a bill that would outlaw lynchings: Sen. Rand Paul, R-Ky.
The House has already passed an anti-lynching legislation, which is awaiting approval in the Senate. But Paul has said he is concerned it could allow more minor altercations to be punishable as lynchings.
"Bruises could be considered lynching," Paul told reporters Wednesday. "That's a problem, to put someone in jail for 10 years for some kind of altercation," referring to the measure's penalty for conspiring or attempting to conspire to commit a lynching.
Paul agreed that lynching should be "universally condemned," but said conflating minor offenses with lynching does a "disservice to those who were lynched in our history."
ABC News reached out to Paul's office for clarification and was pointed to a statement about Paul's proposed amendment to the legislation.
"The bill as written would allow altercations resulting in a cut, abrasion, bruise, or any other injury, no matter how temporary, to be subject to a 10-year penalty," the statement read. "My amendment would simply apply a serious bodily injury standard, which would ensure crimes resulting in substantial risk of death and extreme physical pain be prosecuted as a lynching."

Because a lot of them deserve that.
This bill is ironic, because the left has essentially lynched many cops over several years, declaring them guilty long before investigations or trials and stirring up mobs to attack people and made demands. The left is all for lynch mobs driven by emotions, so long as they are going after the designated “right” people.
From what we’ve just seen, there’s plenty of guilt-ridden whites who will be more than happy to put the rope around their own necks
Murder is already a crime unless you are a Democrat.
“You think I take great joy in being here? No. ...You think I’m getting any good publicity out of this? No. ...I have worked in an honest way with Senator Booker’s office for three months on this bill,” Paul said.
“There has to be justice. People are chanting justice. [But] justice has to have a brain and has to have vision and can’t be hamstrung into something that could give someone ten years in prison for a minor crime,” Paul added.
We’re certainly heading to the lynching of “White” people.

That crap bill reminds me of 0bammyCare. If you don’t buy 0bammyCare then you are given a financial penalty. If you don’t pay the penalty you will be charged with a felony and jailed. .....and if you are a design professional, say a engineer, duly licensed by the state, you will lose your license and thus become unable to practice engineering in any state in the union. I am reminded of a line from a 1930’s gangster movie when a loud mouthed punk looks at someone chastising him and says, “Don’t make a federal case out of it!”
In the world we live in, more and more everything is being made into a “federal case” especially if you are one of us who believes in the rule of law, the Constitution and other antiquated ideas.

eagleone is correct. It will be like hate crimes. Lynching will be whatever the federal prosecutors want it to be.
I suspect that it least part of this whole deal is to give federal prosecutors a second bite of the apple. You cannot be tried twice in a state court for the same crime. The Constitution prohibits that.
But you CAN be tried in a federal court for a crime you were acquitted of in a state court. The feds need only find some federal law that you broke.

Outlaw lynchings? They are already against the law in all 50 states and maybe even 57 states but I would have to check on that.
