Douglas County Attorney calls death 'senseless, but justified', no charges in shooting of protester

OMAHA, Neb. —

Douglas County Attorney Don Kleine announced Monday that there would be no charges against Jake Gardner in the shooting death of 22-year-old James Scurlock, a black man who was killed amid protests in the Old Market Saturday night.

"Douglas County is a community of people I truly love. And I've been very proud of and very proud to serve as the county attorney in this this great county that we live in," he began his remarks.

Kleine said the death of Scurlock was "senseless," because the situation stemmed from what was meant to be peaceful protests.

Kleine said the determination has been made that the shooting was in self-defense. He said that there is video evidence that he wants the public to see and that the decision that has been made is based on all of the information the office has currently.

"The other thing I would ask if there is any other evidence that people are aware of other videos. Other witnesses. Anything else that would guide us or help us in decision making process, we would still like that, to come forward because I'm going to talk to you about the decision we've made it based at this point in time," he said.

My brain is doing flip-flops over the notion of ‘senseless but justified’. If something is justified, there must be sense behind it.

"I knew it was not going to end well," Alayna Melendez said. Melendez, 19, said she had been at the protests Friday and Saturday at 72nd and Dodge and moved downtown closer to home. "Silence is violence," she said. Melendez said as a person of color, she had to jump in to help. "I grabbed him from behind and pulled him to the ground and as soon as I pulled him to the ground, people gathered around us and he had his hand positioned in a way and just shot," she said.

When a person with a firearm is protecting their property from looters, it's prudent to withdraw silently instead of attacking violently. She's a slow learner if she still has not discovered that violence is violence.

This woman is both evil and dangerously stupid. If she gets shot for initiating the use of force at her next protest, I'm okay with that outcome.

The dude showed his gun to warn them and this Alayna Melendez freak jumps on him. Then the black dude jumps on him and gets shot. She literally escalated the situation and is partially responsible.

Videos show G retreating, but letting S know that he was armed. Scurlock attacked G, and was choking him. All of this is senseless.

None of that explains the subject heading (which comes from the title of the article, no fault to Morgana) and says: 'senseless but justified'.

Here's what the article - regardless the title - actually says:

Let’s reiterate the “justified” angle.

Scurlock, the violent looter, was 0% justified in attempting to attack Gardner, the victim.

Gardner, the victim, was 100% justified in shooting Scurlock, the violent looter.

The county attorney didn’t beg for more videos, he told everyone that if there was more evidence out there that had not yet been considered, that they would look at it. They indicated that none of the evidence and videos showed anything except self defense. They are not expecting anything that will change that finding.
