Ex-officer who knelt on George Floyd's neck charged with murder

Derek Chauvin, who was fired on Tuesday along with three other officers involved in the detainment of Floyd, was taken into custody Friday and faces charges of 3rd-degree murder and manslaughter, Hennepin County Attorney Mike Freeman announced.

Floyd pleaded "I can't breathe," as Chauvin, who is white, kneeled on Floyd's neck for around eight minutes on Monday night, in an arrest that was videotaped by bystanders. The police department initially said Floyd, who was black, "physically resisted" the officers and that he died after "suffering medical distress."

Freeman said he anticipated more charges to come, possibly against some of the other three officers.

“The investigation is ongoing," Freeman said, "We felt it was appropriate to focus on the most dangerous perpetrator. This case has moved with extraordinary speed.”

Just 24 hours earlier, Freeman had said the case still needed more investigation.

But by Friday, Freeman said enough evidence had been gathered.

"All of that has come together and we felt, in our professional judgement, it was time to charge," Freeman told reporters.

If they have any non-Erisa retirement assets or 401ks, they are most likely safe from a civil judgment. Hopefully she will get to keep his retirement benefits.

One does wonder. I know that body cams won’t solve every case of “he said, she said” when it involves an arrest, but it does help protect the arrestee and the cop when police brutality cases arise. That said, I don’t know if this cop is mental or what.

The autopsy revealed no physical findings that support a diagnosis of traumatic asphyxia or strangulation.

ME has updated his preliminary findings:

"George Floyd likely died of strangulation and traumatic asphyxia after former Minneapolis police officer Derek Chauvin kneeled on his neck for more than 8 minutes."

I can only assume initial toxicology came back and didn't support an overdose. Or maybe the MA viewed the videos. While his underlying conditions might have made him more susceptible to strangulation/asphyxiation than a 25 year old professional athlete, it doesn't change the actual cause of his death.

That does not mean that the officer’s actions were not the proximate cause of death.

It’s apparent the prosecutor thinks it was.

First, all of the facts are not in. We still don’t know the results of the autopsy. And we still have no video that shows what prompted three police officers to pin Mr. Floyd to the ground.

Second, the fact that this officer was only charged with manslaughter suggests that the evidence is not particularly strong to show that the officers’ excessive force CAUSED THE DEATH . The district attorney gave some ham-handed explanation of the charge stating that they had “sufficient probable cause to charge him.” In my experience, that is a somewhat lame explanation of the charges that you just filed. To lawyers, probable cause is understood as a very slight standard.

There are two developments in this case that should be a red flag to those who think this is a slam dunk case. Yesterday, the DA indicated that there was “other evidence that does not support the charge“ against the officers. Second, the victims‘s family through their attorney has indicated that they are seeking a independent autopsy. Obviously, these Democrat-connected lawyers were advised of the preliminary autopsy results. The only rational explanation as to why they will be seeking an independent autopsy is that they are not happy with the results of the official autopsy.

My position all along has been to wait for the evidence and withhold judgment until that evidence is disclosed. I have stated at least 40 times that I have an open mind. There is a huge red flag that is waving that these officers did not cause the death of the victim. Two things can be true at the same time. First, it can be true that the officers used excessive force. Second, it can also be true that the excessive force did not cause the victims’s death. Until the autopsy results are made public, I still strongly caution that everyone should withhold judgment.

Yes, as I said on another thread, these cases are just an excuse for the usual criminals to go on looting sprees. I doubt that those who really want true justice see the riots are helping.

I don’t think any of us think the officer intended to kill Floyd.
Apparently the DA feels the same as well.
However, Floyd did die while under the officers weighted knee.

We are being blamed for the actions/inaction’s of those who control Minneapolis.

I’m 81 on the west coast and none of this violence is my fault or families.

I feel sorry for his wife and family. Would not blame his wife if she filed for divorce in the very near future. Best way for her to preserve her half of the assets because Chauvin's legal bills are going to be huge.

It appears she just initiated divorce.
