Oregon Supreme Court to Baker County judge: Throw out injunction against governor’s emergency coronavirus orders by Tues., or explain why not

The Oregon Supreme Court on Saturday issued a deadline to the Baker County judge who this week granted a preliminary injunction nullifying Oregon governor’s emergency coronavirus orders:

Either throw out the injunction by 5 p.m. Tuesday or explain why he should not do so.

The OR Supreme Court granted an alternative writ of mandamus. If the Baker County judge doesn’t withdraw his injunction, the state’s high court asked for further legal briefs on the question of whether the trial court should be ordered to dismiss it. It appears the onus has been put on the County judge and not Kate Brown to prove their case. Doesn't sound good since the County judge states his case supported by the law whereas Kate Brown's arguments are nothing more than blue state talking points.

Marriage between a man and woman written into law, leftists judges overrule because people are more important than law.
Prop 8 a public vote legally put on the ballot and voted on by the people in accordance with the California constitution legalizing that marriage is only between a man and woman - ignored and struck down by leftist judges because people are more important than the law.
Sanctuary cities - accepted by leftist judges (but only as they pertain to illegal immigration) because people are more important than the law.

Now watch out, governors placing entire states under house arrests - leftist judges say we need to follow the law because people aren’t above it.

But the court also invited amicus briefs, so that indicates they want to have the issue fully argued from both sides.

Or they at least want to have that appearance, while delaying a decision while the lockdown remains in place for another 2 weeks

These emergency powers are a travesty. Something has to be done to severely curb them.

The idea that a governor or a mayor can unilaterally declare an emergency and in the process assume enough dictatorial powers to throw the constitution under the bus is banana republic stuff.

Any emergency declaration must be approved by the legislature and must expire over a predefined short period of time. It can be renewed if the legislature decides to do so.

Yep. Any emergency powers should expire in at most 14 days, unless the Governor convenes the legislature to approve a longer time frame. From that point on they must me re-justified every 14 days or when the Gov wants any changes made.

I live to the north of Oregon in Washington State and we also have some issues with our State Supreme Court. All 9 are leftists. Having said that, there has always been a strong civil libertarian streak on the Court which may help out with a lawsuit pending to throw out our lock down orders handed down from Mt Olympia by false prophet Inslee. I spoke with an Oregon activist yesterday and learned a few things I didn’t know. He claims that unlike Washington, Oregon only has 7 supreme court members but in fact 6 are Kate Brown appointees and are ALL political hacks! Also, Kate Brown is the little sister of former CA Gov Jerry “moonbeam” Brown and obviously then the daughter of former CA Gov Pat Brown. No wonder corruption runs rampant in Oregon.

sounds like a Gen Flynn court judge, Sullivan, and his appointing a leftist to argue against the DOJ decision to drop all fake charges against the soldier.

If you can’t or won’t make a sane decision, screw up the process.

The Oregon Supreme court is insanely liberal and the majority was appointed by Kate Brown, so I tend to think they are doing this for the appearance of impartiality and don’t give a flying fig about the statutes or the constitution.
