Various sources (e.g., Sundance at conservativetreehouse.com) say that Flynn’s calls were being intercepted by a “Pen” register on his government issued Blackberry. Implication: Flynn was not being surveilled under a FISA warrant, at least during the post-election period.
It’s also been noted that charging Flynn with a Logan Act violation (private citizen conducting foreign policy) is bogus on the face of it. The calls with Kislyak were on a government phone issued to Flynn to conduct government business.

I think we’ve been going about this wrong. Comey and the FBI had set up an illegal wiretap of Flynn in order to get dirt on him so they could make sure he wouldn’t be Trump’s Intelligence Chief. Flynn knew where all the skeletons were buried with regard to Obama’s illegal Iran dealings and the gun running in Benghazi. If Flynn were ever to have control of the intelligence apparatus, they’d all go down.
They “by the book” reference is to make sure it “appears” Flynn’s name was inadvertently discovered during routine monitoring of Kislyak. That way, they can say they unmasked Flynn as a direct result of the legal monitoring as opposed to the illegal wiretaps of Flynn that they already had in place. I think that’s why the “by the book” reference is in quotes. They had to make sure it looked like a legal intercept rather than an illegal one.
I predict that Catherine Herridge will soon be muzzled, silenced, or fired by CBS News, as she is getting way to close to the truth of the unprecedented corruption of the Obama administration. How can CBS just stand back as she blows up all that the MSM has been corruptly defending for so many years?

Another thing Flynn had done to tick off Obama isnsay that the Obama admin was hiding the information about Iran that was found in the bin Laden raid.
The only reason for a “by the book” reference is CYA because it wasn’t by the book.
It’s outrageous we still do not have the basic facts of the Flynn entrapment a year after Barr became AG and 3 1/2 years after the event.

Here’s Byron York with some declassified court papers indicating that top Justice Department official Sally Yates learned about the phone call between Michael Flynn and Russian Ambassador to the United States Sergey Kislyak from President Obama himself during a meeting in the Oval Office in early January 2017.
