Catch-22 With Brady Exculpatory Evidence
Powell notes that the prosecution refused to provide Flynn with the Brady material before he accepted the plea deal because he was not a defendant until he was formally charged. But then they claimed they didnt need to provide him with the material after he had accepted the plea deal since the guilty plea erased the obligation. It was a catch-22 that defeats the purpose of the Brady requirement.
Powell charges FBI lawyer Lisa Page with altering the FD-302 write-up of Flynns interview. Peter Strzok, an FBI agent at the time and Pages extramarital lover, drafted an FD-302. He texted Page about making some changes to the write-up. Page had not been involved in the interview. The change in wording moved Flynn from a target to a subject.
This FD-302 originally said Flynn could not remember if he had spoken to Russians about their voting at the UN. It was revised to say Flynn said he did not talk to the Russians about that. This contradicted what Vice President Pence had just said on TV, that Flynn had not discussed sanctions with Russians. He was forced to resign.
Changing the words regarding a person under investigation can have a profound influence on the outcome. Strzok changed former FBI Director James Comeys drafting of gross negligence in regards to Hillary Clintons use of a private email server to extreme carelessness. This took her out of the criminal statute regarding mishandling of classified information, and allowed her to avoid prosecution....

Yeah, started out as an officer at Auburn prison in 1980 at the age of 33. Transferred back to a prison closer to home in 1983. Made Sergeant in ‘89, and retired in 2003. Got a reprieve, and got out almost 24 months early because I was in Tier I of the Retirement System. I received one month’s early retirement for every year’s service in Corrections that I had, as long as I was over 55. I had previous time in the State Retirement System, and ended up with 33 years of service under my belt. I’m a female, and will be 73 in August.
Makes wonder how many other folks got the short end of the 302-stick?

I'd like to get your opinion on States/Counties releasing prisoners for various reasons some time. Here in Kalifornia, they are releasing prisoners because of the threat of COVID spreading through the jail/prison population. Plus, we now have a NO BAIL release program on certain charges.
I can imagine how the street cops feel about making a bust to see the same person back on the street just hours later. It must be demoralizing.
I had 3 years experience as Shore Patrol while Navy. Nowhere near as dangerous, but I had my share of physical tussles with drunk sailors and Marines when the bars/clubs closed.
My proudest moment of being Shore Patrol is when I volunteered to work under cover with NIS (now NCIS) and the Gibraltar police to break up a heroin ring from Morroco. It was right out of a movie and very rewarding. Freepmail me if you're interested in the operation. It's not classified.

PIENTKA Horowitz report spotlights little-known FBI agent’s role in Russia probe, Flynn case
ARCHIVES Inspector General Michael Horowitz’s long-awaited report this week on FBI and Justice Department surveillance abuses does not provide the name of an unidentified FBI supervisory special agent (SSA) who made a series of apparent oversights in the bureau’s so-called “Crossfire Hurricane” probe into the Trump campaign.
However, a review of Horowitz’s findings leaves little doubt that the unnamed SSA is Joe Pientka — someone who could soon play a prominent role in the ongoing prosecution of Michael Flynn, as the former Trump national security adviser fights to overturn his guilty plea on a single charge of making false statements.
Specifically, Horowitz’s report states that “SSA 1” was one of the FBI agents to interview Flynn at the White House on Jan. 24, 2017, in a seemingly casual conversation that would later form the basis for his criminal prosecution.
It was previously reported that the interviewing agents were Peter Strzok, who was later fired by the FBI for misconduct and anti-Trump bias, and Pientka, whom Strzok previously identified as his notetaker for the Flynn interview. Flynn’s attorney has also mentioned Pientka’s role during past court proceedings. Of the two agents, only Strzok is openly named in the Horowitz report, which strongly indicates that the other is Pientka.
“SSA 1,” Horowitz’s report states, may have helped mislead the Foreign Intelligence Surveillance Court (FISC) about material facts concerning former Trump adviser Carter Page and British ex-spy Christopher Steele, whose unverified dossier played a central role in the FBI’s warrant to surveil Page.
Page has not been charged with any wrongdoing, even though the FBI flatly called him a foreign “agent” in its surveillance warrant application. And former Special Counsel Robert Mueller’s Russia investigation, which concluded earlier this year, found no evidence that the Trump campaign had engaged in a criminal conspiracy with Russians to influence the 2016 election, despite multiple outreach efforts by Russian actors.
ALL EYES ON DURHAM, AFTER HE REBUKES HOROWITZ’S CONCLUSIONS
On Aug. 1, 2016, just after the official inception of the FBIs investigation into the Trump campaign, Strzok and Pientka traveled overseas to meet with the Australian officials who had spoken with Trump adviser George Papadopoulos in May of that year. The officials had overhead Papadopoulos mention his now-infamous conversation with Joseph Mifsud about suggestions of potential Russian leaks of Hillary Clintons emails, apparently touching off what would become the Russia probe.

I have a big problem with States releasing convicts because of the virus. There's been plenty of other epidemics/pandemics in the past that didn't require these actions. Most people doing time were offered a plea deal to a lesser charge, which means they aren't doing the time for the actual crime they committed...so already they've gotten a break. And not requiring bail is just plain crazy, and the officials who put those policies in place, have blood on their hands, because some have already committed new crimes, even murder. It's all on the people who made it possible, and they should be held accountable. I wouldn't want to be a cop on the street today. I always felt safer behind the walls, because you knew what you were dealing with.
I'm glad I was able to retire when I did. I worked while Mario Cuomo was Governor, so I can imagine how low morale must be among the prison staff under his son. He managed to murder over 5,000 elderly people in nursing homes, and the bastard will probably never be held accountable. I only hope that the people downstate will come to their senses, and remember how he unnecessarily destroyed people's lives. We got rid of his old man by electing George Pataki. It would be nice to be able to do it to his son, but the New York GOP needs to nominate someone good, not a RINO, and work hard to get them elected. The NY GOP doesn't have a good track record for that however.
I doubt New York will ever be what you knew it to be. Yes, Cuomo is guilty of his stupid policy that created more deaths in assisted living facilities. This whole shutdown of our Country is insane. If COVID went away tomorrow, there will still be many millions affected over many years. Take care.

I laugh when I hear people ask why it took so many officers to get control of someone. Unless those people have ever been involved in one of those situations, they have no idea how many people it can take to control one person.
