Catch-22 With Brady Exculpatory Evidence

Powell notes that the prosecution refused to provide Flynn with the Brady material before he accepted the plea deal because he was not a defendant until he was formally charged. But then they claimed they didn’t need to provide him with the material after he had accepted the plea deal — since the guilty plea erased the obligation. It was a catch-22 that defeats the purpose of the Brady requirement.

Powell charges FBI lawyer Lisa Page with altering the FD-302 write-up of Flynn’s interview. Peter Strzok, an FBI agent at the time and Page’s extramarital lover, drafted an FD-302. He texted Page about making some changes to the write-up. Page had not been involved in the interview. The change in wording moved Flynn from a target to a subject.

This FD-302 originally said Flynn could not remember if he had spoken to Russians about their voting at the UN. It was revised to say Flynn said he did not talk to the Russians about that. This contradicted what Vice President Pence had just said on TV, that Flynn had not discussed sanctions with Russians. He was forced to resign.

Changing the words regarding a person under investigation can have a profound influence on the outcome. Strzok changed former FBI Director James Comey’s drafting of “gross negligence” in regards to Hillary Clinton’s use of a private email server to “extreme carelessness.” This took her out of the criminal statute regarding mishandling of classified information, and allowed her to avoid prosecution....

They had to alter the 302 because the original did not contain evidence of any crime. There was an irresistible force pushing for the prosecution of Flynn, and the FBI was a very movable object.

If this is public knowledge then why isn’t Strzok in jail? I guess I’m just tired of thinking about it.
Another case where an obviously guilty party goes free as with Lois Lerner and so many many others.

Federal courts should refuse to hear any case brought before them with FBI evidence, testimony, or supporting documents. They have no interest in justice. They found political masters to serve with zeal. Let them be the pariah they are.

The FBI has become an evil institution, letting this travesty continue. It needs to be disbanded, and reformed. It’s now proven to be a threat to the american people, to justice. It needs to be gone in its current version before it does more damage to innocent people. It has become the American version of the KGB.

It’s become a sick joke. How can any honest judge convict anyone on the evidence that this organization manufactures?

They can’t. Its corrupt. Obama corrupted the entire government.

The fbi has been entrusted with power over citizens. It has abused that trust. Given that it has the power to detain, deprive of liberty, property and life, the agents involved should be thrust into prison for life. Of course, it won’t happen.

From now on 302s used in a court should all be challenged as unreliable documents. Site this case in support. All of them in any and all cases.

No 302 should be admissible unless the entirety of the interview process was video recorded (with the subject having the right to make his own recording, and also being given a digitally-signed copy of the FBI recording). The 302 should be just a summary of the recording, with the FBI agents being liable for perjury.

The entire process by the FBI is corrupt.

No recordings of interviews. Just “notes” made by the FBI agent. I mean, what could possibly go wrong?

Too many Republicans we’re behind this along with those democrats.

THAT is why all these “news” stories (that we heard about YEARS ago) are only now coming to light... and it’s the Republicans saying “now, now... we have to make sure and get all the facts right and checked out... can’t jump to conclusions!..”.

We need some old-style justice for 99% of our elected “representatives”

I have been pondering an interesting aspect of this.

Bongino made the point that imposing sanctions on the Russians and kicking out the diplomats were two separate things, and were treated as such by both The Washington Post AND The New York Times. And nowhere in the call does Flynn actually discuss sanctions (according to Intelligence officials who have seen the trancript)

It is is said that the Ambassador asked a direct question about sanctions, and Flynn brushed it off with a “Let’s not discuss that now” type of response.

He discusses the ejection of the ‘diplomats’ which is a different thing.

When he talked to Pence and supposedly “lied” to them...did he really? I wonder now, because I wonder if Flynn saw the sanctions and ejections as two clearly different aspects of the whole situation, and when Pence asked him about whether he discussed sanctions and he said “No”...and was being honest.

They DID talk about the ejections and the “PNG” status (Persona Non Grata) which means they can NEVER return to the USA, but...did NOT discuss sanctions.

But the media came out and along with the FBI was saying Flynn talked about sanctions. What if he really didn’t

But the media drove that entire narrative. I wonder if they did that out of ignorance, or...if they knew that they were conflating the two aspects of the whole situation.

When I contemplate a similar sentiment about the actions of Leftists, I quickly remember the answer: They have deluded themselves into truly believing that the ends justify the means.

Then I understand.

It’s a self-deception of the highest order and it allows them to fully justify their actions in their own minds, which allows them to sleep peacefully and without guilt.
