What happened to the premise in the Obama administration that government has the discretion to not pursue enforcement of the laws?

Wasn't that the SCOTUS ruling over the Arizona SB1070 bill regarding state enforcement of federal immigration law?

Based on that same reasoning, doesn't Barr have the same discretion to not prosecute, say, Lt. General Flynn?

If this judge thinks he can force Barr to prosecute Flynn, why couldn't the prior judge force Holder to prosecute Arizona illegal aliens?

I take it the argument will be that he perjured himself by admitting to something he didn’t do.

If Sullivan and his pals think they can get away with this mockery of justice, they are in for a very unpleasant surprise.

The crime has been dismissed you can’t pardon a non existent crime!!

Actually it has not. The DOJ has requested a dismissal as has the defense. The DOJ has said they will no longer prosecute because the evidence was not there for the case ever to be brought, and because of egregious prosecutorial bad behavior. . . And because there was no crime in the first place. The judge is claiming the defendant plead guilty, so that’s all there needs to be: a guilty plea. But the DOJ says you cannot plead guilty to a non-existent crime. The Judge begs to differ, and wants his sentencing.

The judge just became a biased prosecutor and has nominated his own prosecutor.

This would seem to be a major judicial misconduct charge and a disbarment.

When Flynn pled guilty to making false statements to the FBI he had no idea that the entire government investigation was not legitimate, only the government would’ve known that. Which means Flynn did not commit perjury in making his plea deal. He never actually committed a crime but he had no way of knowing that at the time of his plea deal.

Judge Sullivan deserves impeachment IMO.


But since he’s carrying the democrats’ water, that will never happen. Dems are claiming that the Flynn case is distracting from the real issue: ORANGE MAN BAD!

In this case, it seems Gleeson is appointed (outside any Constitutional authority or confirmation) to represent the USA.

See my post #70 citing Ginsberg's opinion last week in 9-0 decision which said that a Judge cannot do that.

Sullivan - also orders Gleeson to address whether the Court should hold Flynn in contempt for perjury.

Let's give a shout out to that tiny number of astute Freepers who identified this problem for Mike Flynn months ago.

In order for him to withdraw his guilty plea he had to admit that he stood up and lied to this judge's face at least twice.

Perjury requires that you knew that the statement was false when you made it.
