BREAKING: Judge SULLIVAN has appointed retired judge to argue against the government's motion to dismiss the charge against Flynn.
So what is Sullivan trying to accomplish here? To get his opinion on the record, presented by a retired puppet Judge who will mimic Sullivan's own words in the amicus brief?

Surely you can’t charge someone with perjury for withdrawing a guilty plea? Then everyone that has ever done that is guilty of perjury

t makes sense Sullivan to ask for a brief against dropping charges so he can not be accused of bias later.
This makes sense? Yep. Sullivan is a white hat. No doubt. He’s getting ready to come down hard on DOJ for prosecutorial misconduct. Right after he jails Flynn for contempt of court. Just you wait and see.
Superior courts in the DC Circuit, The US Supreme Court. The President of the United States. This Judge is just drunk on his authority.

Missing the point. Flynn is not charged with perjury. He was accused of lying to the FBI (which is different and less serious than perjury) and he pled guilty. But the DOJ now indicates that the FBI was not lied to. So Flynn is guilty of what? He migth serve time for what?
It is Kafkaesque to put him on trial for trumped up charges and then jail him BECAUSE he gave up the fight and said “If you say so”.

Yes he did. He said it was unprecedented for anyone to have charges for perjury dismissed. The only thing is, that General Flynn wasn't charged with perjury. But with a nudge from Obama, Sullivan may be attempting to pursue that. Like Comey did, the Judge is trying to usurp the legal authority of the Attorney General.
Impeachment process needs to be followed. Need Republicans to win house and senate in November.
And suppose Republicans win back the House and somehow retain the Senate. How many Republicans would vote to impeach and remove this judge? Ten?
You need 67 votes in the Senate to remove him. Even with a GOP majority, it wont be close.
This coup needs to be put down by force or it will succeed.
He’s also the one who gave HSBC a little tap on the wrist for their massive crimes. That would be the HSBC that Comey was on the board of.
There has to be something wrong with this and we shall find out all about.
In addition to Sullivan’s legal missteps, he has created a victim in Flynn.
Flynn has become someone who historically is a winner in the Great United States of America.
Flynn had become a sympathetic figure, more so now, because he is now THE UNDERDOG.
Americans have always given great support to underdogs.
Perhaps our Atty. General Barr doesn’t quite know what to do about this. This “bug” should have been administratively squashed the moment it was pitched.
A retired judge is still a judge having Senior Status unless theyve completely stepped away, like Ken Starr and Michael Chertoff. A district judge on Senior Status has a reduced workload (3 jury cases a year in the WD of OK). They get reduced salary, but enjoy full chambers, and library, and clerks.
Gleeson resigned in 2016 and went to private practice. Gleeson stepped away completely. This is usually done if the judge believes he can earn more $$ away from the bench.
The appointment, without any input by the parties, is irregular. Some federal judges think they can do anything - and they are snapped back by the circuit courts. I would imagine that the DOJ and Ms. Powell is framing their separate tactics currently. Note there is no time mentioned for a decision (that Ive seen). First question of any lawyer is always, who is my client. It is that person/entity to whom all privileges and rights are assigned. In this case, it seems Gleeson is appointed (outside any Constitutional authority or confirmation) to represent the USA. Pardon my cynicism - that dog wont hunt. I wonder who is paying for Gleeson? If not the DOJ, they cant be his client. If it is by the Judicial fund, it is an illegal expenditure. Perhaps Gleeson is doing this pro bono? I suspect not.
