Just to play devil’s advocate here:
Say I am a completely innocent person and am jogging down my street and there is a truck parked in the way so I jog around it...when I get to the front of the truck you stick a shotgun in my face and tell me to stop. I now feel threatened and in fear for my life so I grab for the gun. You shoot and kill me.
Who if anyone broke the law?
I suppose the trial will determine that.
Your assuming he did point the gun at his face. They are obscured by the truck at this time. He was carrying the shotgun at what appeared to be the low ready as he went to cut Arbery off at the passenger side of the truck. If he is at the low ready and Arbery grabs the gun his first reaction would be to bring it up.Then if Arbery pulls on the gun, he effectively shoots himself. The second DA on this case pointed that out in his letter to the police captain about why he was not charging the McMichaels.
There’s two videos on the internet that show the jogger walk up the street to the house, stop look around and then go inside. One shows a neighbor across the street come out into their front yard at which time Averby streaks out of the house and down the street.
FWIW, the night photos show another entry prior to the day Averby was killed. The one in daylight shows he wasn’t wearing socks while out for his daily “jog”. I’m waiting for the autopsy report to show if the soles of his feet had unusual calluses. If not, the man wasn’t jogging.

Hypotheticals dont appear to be your strong suit.
Where do you work in the part about you dropping the hammer you were carrying when you see the armed men in front of you?
Also, where did you get that hammer? Did you steal it off the house you invaded?
Oh wait. You said you were a "completely innocent person", so I guess you wouldn't have to worry about the hammer. Also, why would two guys with guns be wanting to stop you?
I have my own idea about it... Let's just say that I've been to CCW class twice, and had... other training in self defense and the law in my home state as well, and leave it at that. Oh yeah, I did stay at a Holiday Inn last nite.
Welcome to FR, BTW. :)
