Court reinstates California ammunition purchase law

An appeals court has reinstated a California law requiring background checks for people buying ammunition, reversing a federal judge’s decision to stop the checks that he said violate the constitutional right to bear arms.

The 9th Circuit Court of Appeals on Friday granted the state attorney general’s request to stay the judge’s order.

“This means that the same restrictions that have been previously in effect regarding ammunition in California are back for the time being,” the National Rifle Association, which hailed the judge’s injunction, said in a news release.

The law, which took effect last July, requires Californians to pass an in-store background check before buying ammunition, which involves running buyers’ names through a California Department of Justice database that tracks legal purchases of guns.

Gun rights activists complained the law’s red tape and database errors unfairly limited legal purchases of ammunition.

While inconvienient, one simply goes to another state to buy where such restrictions are not in place.

NY tried this, under the SAFE Act, and while ti was not implemented as far as I know, I don’t buy ammo in NY, just beacuse. I drive a couple of hours to PA where they don’t have any restrictions (yet) and stock up.

Yes it’s a pain in the arse, but I do no want my name in any NY registry.

This same judge is the one that tossed out the 10 round magazine ban and issued an injunction against enforcing it, but was forced to rescind that injunction. For about a week, Californians could buy standard capacity magazines and did so in the millions.

It's not surprising that this judge's injunction against enforcing the ammunition background check law was also rescinded.

Does Massachusetts still require their Firearms Identification Card to purchase ammo and the sale is still recorded?

From an earlier article, it’s apparently illegal to cross state lines to buy ammo and bring it into California. How that’s enforced? No idea...

There is a device called an OBD which shows why your Check Engine light is on. You can borrow it from Auto Zone. Except in California where that is illegal. I found this out in the border town of Laughlin. I simply drove to the Nevada side of town and resolved the issue there.

From what I've read, CHP or associates are scanning license plates at gun shops in adjacent states and pulling these people over when they enter California.

Now, for the REST of the story.

It was just TWO judges, not the "Court".

The appeals court, represented by Judges Mary H. Murguia [ClownBammy "judge"] and Mark J. Bennett [Trump judge], didn't address the arguments.

Murguia is Bad News, and she's likely the next Chief Judge of the Ninth in 2021.

I'm wondering if she pulled rank on Bennett, because she's the most senior of the judges on the Ninth Circuit after the current Chief, Sidney R. Thomas [Rapin Bill judge].

Yes, inconvenient but also illegal under the California law. Importation of ammunition from out of state is illegal.

She didn’t have to “pull rank” on Bennett. He was Trump’s first appointee to the 9th and has its “Hawaii seat”. I’m not sure who recommended him but, in many ways, he might as well be a DemocRAT appointee. Perhaps he was the best they could find from Hawaii?
