On Wednesdays broadcast of the Fox News Channels Tucker Carlson Tonight, New Jersey Governor Phil Murphy (D) stated that he wasnt thinking of the Bill of Rights when he implemented his states stay-at-home order, but that he did consult with legal counsel.
Murphy began by defending the order by arguing that there wont be an economic recovery until theres a complete or near complete healthcare recovery. And that more testing in the state would be helpful in reopening.
Murphy later defended deeming liquor stores an essential business, saying that the decision was based on input from addiction and recovery experts that shutting down liquor stores would have unintended mental health and addiction prices to pay, unintended consequences.

Nor did he consider the health and well being of people when he issued orders preventing primary care physicians from prescribing hydroxychloroquine in the earliest stages of COVID-19 infection. People are dying since they do not have timely access to this drug.
The Declaration of Independence says we have unalienable rights among which are life, liberty and the pursuit of happiness, and goes on to say that to secure these rights governments are instituted among men.
The First Amendment covers freedom or religion and of assembly.
The Tenth Amendment states The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
So maybe a State government does have power to temporarily restrict religious expression or assembly of other types when the rights to those things come in conflict with the right to life and possibly the pursuit of happiness during a lethal contagion.
Maybe.
When rights come into conflict we normally settle the issue through legislation and the courts and sometimes voting. I dont know what laws and decisions have been made in regard to all this in any particular state but they may be inadequate, both to protect the people from lethal contagion and to protect the people from abuse of the state power.
If enough people sufficiently oppose how legislation and the courts settle any conflict of rights, the Tenth Amendment does say or to the people and the people have most of the guns.
Murphy is another little power mad Dem who needs to be removed by the people immediately.
Sad part is many people agree with him, except a few of us radicals.
I watched his performance, pathetic, deer in the headlights. “That is above my paygrade”, no it is not numb nuts, you are the Governor of the State of New Jersey.
Andrew Cuomo refered to the Tenth Amendment...when it suited him.
If elected officials don’t think about the Bill of Rights, what do you suppose the unelected, union-protected bureaucrats and apparatchiks think about it?
