The action is perfectly legal. Also, found the following from 2011 when the Daily Beast wants Obama to Adjourn Congress so Obama could make recess appointments. Will be interesting to see if the Daily Beast says it is illegal if Trump does it. Here is the link:

That was a different issue, as I recall. Obama didn’t adjourn Congress, he just claimed that their BS pretending to be in session was really a recess, and made appointments. The court said that it is up to the Senate and House to determine if they are in session, the President can’t do that for them. Unless, of course, he uses his Constitutional power to adjourn them. Then it’s not up to them.

The GOP Senate is run by Mitch, even before Pelosi took over the House the GOP House was hamstringing President Trump.

...and in Case of Disagreement between them, with Respect to the Time of Adjournment, he may adjourn them to such Time as he shall think proper... I don't think the problem is a disagreement between the House and Senate on adjourning.

I got this from the article in post 5.....
The President can make a recess appointment without Senate confirmation when the Senate says it is in recess. But either the House or the Senate can take the Senate out of recess and force it to hold a “pro forma session” that will block any recess appointment. So while the President’s recess appointment power is broad in theory, if either house of Congress is in the hands of the other party, it can be blocked

Joe Biden will not win. Biden is hated by most of the Democrats at Yahoo. When he entered the race, the comments were 90% against him. It was a pleasant surprise.
IMHO, the DNC will have to waddle out Hillary as his VP. That would excite the Democrats.
