The couple should have rented a motel room...After hiring a babysitter for the girl...Or the woman could have asked one of her relatives for help...

There are some swingers who have kids...I don't think a couple would have "fun" in the living room, with some other couple, while the son is in his room...

The guy is 21 years older than the lady...

Or just lock the bedroom door.

But this sounds like a prosecutor looking for a win to score political points. Not a real crime.

But I may be wrong.

When asked how investigators learned about this, Salt Lake County District Attorney Sim Gill said that the charges are based on the totality of the evidence, which includes additional information that may be revealed in court...

Big Brother surveillance state.

Around that age I woke up in the middle of the night and wandered into my parents bedroom. My mom told me to go back to bed. As an adult I realized I had walked in on them.....oops

“...that points to the couple intentionally engaging in the conduct.”

Is there any other way?

Let’s call it an offense against innocence.

Innocence needs to be protected, untlil the mind matures at an age when adult things can be undesstood and appreciated at an adult level. Offenses against innocence often lead to unresolved emotional and psychiatric issues in the child, from experiencing or witnessing initimate matters they could not understand when the event(s) ocurred. They can be manifested in how badly the child forms their personal relationships later in life, and by later it could be as early as their later childhood and all they way into adulthood. As much as these things need to be resolved most do not even realize wherefrom their personal relationship issues come from and most often do not seek help to find out; going through life handling their issues however they can, however gives them the least anguish.

They usurped the kids future teachers right to teach about such matters. The kid is only 3 and 2 years from now his teachers will teach him all he needs to know.

Boy, when I was dating one of my exes, her apartment was weirdly designed, so her bedroom was between her kids’ bedroom and the bathroom. The apartments was created out of a home of a mill owner. Her oldest son saw us a few times. (He was the only one completely toilet trained since he was 7) It shouldn’t be acrimeunless they didn’t stop.

What about obama? Childern watched for years as he screwed their mothers (and their fathers, too, for that matter ... he’s “ambidextrous”, y’know).

For thousands of years, the average person may not have had more than 1 to 2 rooms total in their homes. For much of history before the 1800’s children and parents would sleep in the same bedroom until the children left home for good. Sex was not some taboo subject (the kids could watch the farm animals every spring), and children were not harmed. This modern prudery is stupid.
