A judge in Lyon County has ordered a weekly motel to pay $2,500 in damages to a tenant the business locked out in the days following Gov. Steve Sisolak’s moratorium on evictions.

The ruling, issued Wednesday in Lyon County Justice Court in favor of the tenant and against the Extended Stay Suites in Fernley, appears to be one of the first instances in which a Nevada court has enforced the order Sisolak issued on March 29. In addition to the statutory damages, the judge ordered the motel to pay $299.13 in actual damages to the tenant and immediately allow him back in his room.

Abolition of private property rights.

When you create a tenancy you gave up many property rights. In return for rent you invited someone to use your property as his home. Don't like it. Don't rent.

Property taxes aren’t voluntary.

You no longer own property.

You rent it from the government.

It appears he went to work and came back to a locked out situation with no notice.

That was illegal in any case, I think.

You also have rental agreements that allow you to evict for non payment after a certain time.. That is called a written contract which is legal.. The governor has no right to take that away.. Nor a commie Judge..

of course if the Motel owner talked to the tenant and agreed to the tenants request then the Judge was in his rights to issue a fine. There also might be extenuating circumstances!

Let us emphasize a point here. The landlord locked the tenant out. That is something no landlord has a right to do. Tenant not paying rent - you file for a summary hearing for eviction. He didn’t do that.

What an incredibly stupid remark.Do you have any idea what proportion of property is rented in this country? Perhaps you would like Chase, Att&t, Whole Foods, ....etc to stop renting?

I am merely responding to the my property is my property and if I want to evict a tenant, well it's my property goons. You rented the property, the tenant is now in possession with lots of associated rights. Don't like it. Don't rent. It's a principal of property law that goes back to the dimmest dawn of government in England.

Provided your rental agreement allows you to do so. Your property is your property, but a contract is also a contract. If both parties sign, agreeing that a landlord cannot lock out a tennant for any reason, or even if he can for a limited number of reasons, you have to abide by that contract. You signed it.

There is also a huge displacement of power in landlord/tennant relationships, which is why there are rental agreements and laws protecting tenants from undue actions, such as evictions and harassment. I’ve been a renter, and I’m not looking to do it again. My landlord didn’t look happy to see me read the entire rental agreement before signing, whereas my roommate didn’t bother reading it at all. He’s a Liberal.

I’m sure we don’t have every detail of the situation, but as I look at it, I don’t see this eviction as a legitimate one.

Super long-ass rant, and call for assistance, I’m ready to be roasted. This is somewhat relevant to the post I’m replying to, but my anger at the Communist Chinese keeps making this rant grow. I lost everything.

Got furloughed from my job at the end of March. so went from after-tax 11K a month to 0K a month instantly. Been putting the maximum into my 401K to try to catch up the 20 years I was overseas and investing in overseas real estate heavily.

Impossible to find any employment in my area of experience, especially due to the Coronavirus and the fact that 99% of the recruiters in my industry only will hire Indians and I never made it past the initial recruiter phone screen since re-entering the job market at the end of April. I answer the first question which is always “what’s your visa status?” And my answer of natural-born US citizen usually means the initial phone screen is over within a minute afterwards.

I’m a software engineer, with a secondary field of undergraduate college/university teaching. I also run software game projects, all put on hold since the Coronavirus. Can’t get the PPA or SBA assistance due to my low personal FICO score. Trying to be a good entrepreneur as well. Trying to get a kickstarter or investors for a AAA video game I’ve been working on, no dice.

I’m also a landlord, and have rented out my resort beach house in the Philippines for about $2000 a month. I just needed to add between $0 and $400 per month to cover the mortgage. Due to the lockdown there, all resorts are closed. Mortgage still has to be paid, and was scheduled to be paid off within the 10-year maximum. Car payment there also has to be paid there. I know. Priorities, as one month late means foreclosure and repossession. But I digress again. So yeah, my monthly expenses were equal to monthly expenses, with all extras going for retirement or other real estate type investments

Called my landlord and my other creditors here as soon I was furloughed. Most creditors were ok. Only 2 were not. Landlord said if not paid at end of April, instant eviction. I will stay through May as I paid that last month’s rent and deposit when I moved it. Landlord told me Colorado law doesn’t apply as she owns less than 10 units. I do understand and prepared to spend time living in car if need be (see below)

Courts will be jammed pack with evicted tenants as soon as the eviction moratorium is lifted. No way will any tenant be able to pay anything back. the $1200 stimulus payment won’t cover ever the rent here in Colorado. And that’s still in process for most.

2nd one was when I first arrived back in the US after teaching internationally for 30 years, I was I was stuck buying from a Buy-Here, Pay Here scumbag due to my non-existent FICO score. If planning to work
overseas, keep at one US-based credit card. I stupidly didn’t 20 years ago and my FICO score was reset to 0 after 10 years.

Asked to defer my loan payment for 15 days until my Colorado Unemployment kicks in, which might be mid-May as their system is overloaded. They didn’t take the payment out automatically in middle of March (their system was down and I use ACH) and so they demanded immediate $800 on April 10. It was to be the final payment at 56% interest, but was I making payments easily for over a year. They shut my car off. Had it towed home and I removed the starter kill device. Hooked it up to a 12V battery and plan on throwing the device onto on a passing train. I live in an area where there is no public transportation and an Uber to the nearest town is north of $40 one way. Was I a scumbag myself for going into survival mode and removing the device? Yep. I self-admit to that.

I, unlike most here, only have 1 prepaid credit card for $300. So using credit cards for living expenses temporarily is a non-starter. And my personal possessions here amount to some clothes, exactly 1 paid-off cell phone, 1 paid-off laptop, and some cheap Wayfair furniture. I tend to live frugally as I hate leaving apartments full of furniture. Everything else shipped back home already at the start of this crisis.

What to do? Looked at upwork, etc. most jobs in my skill set pay $5 to $10 an hour tops (Indians and others absolutely dominate that as well and drive project wages way down). DoorDash and Postmates possibilities are way down as everyone is doing it now to survive. Tried this weekend and got only $100. Too many others doing it now.

Want to train to be an OTR truck driver as a tertiary skills field. Colorado DMV closed for the foreseeable future. A school is offering free CDL school for veterans, but start date in Mid-May to June now. and no pay for 4 weeks while in the CDL school.

Have another job offer in shitsville, but hiring freeze until the campus allowed to open by Newsom - trimester *was* to begin May 11, but put on indefinite hold now. Can’t teach most of the stuff online there. Most students don’t have access to green screen facilities, audio studio gear, render farms, professional camera gear or VR setups.

Rant over. I guess this conservative is really a whiny liberal pussy, after all.

Well we own a rental property and here the government doesn’t tell us we have to take it in the shorts! If the guy is a flake you can evict him I don’t care what some dumb Judge thinks. Doesn’t make it right.. The guy would be out on his ear.. Three days max!
