ICE announced Friday that it had defied a California sanctuary law and arrested a repeat-felon illegal immigrant outside of San Franciscos Hall of Justice this week, prompting angry denunciations from local officials.
The arrest is the latest escalation between the Trump administration and California over immigration enforcement, with the feds pushing back hard on the states sanctuary policies through lawsuits, subpoenas, and now flouting the states own laws.
ICE said it had tried eight times to get local authorities to turn over the man, who was not identified by name, but each time those detainer requests were rebuffed.
So they tracked him down as he was about to enter the courthouse for a hearing, and made the arrest.
Our officers will not have their hands tied by sanctuary rules when enforcing immigration laws to remove criminal aliens from our communities, said David Jennings, director of ICEs San Francisco field office.
California last year enacted Assembly Bill 668, which attempted to make courthouse arrests without a judicial warrant illegal. That was aimed at ICE, which when its enforcing civil immigration laws cannot obtain a judicial warrant, but makes arrests on administrative warrants instead.
Mr. Jennings said ICE wont let that law govern how federal officers, following laws passed by Congress, do their jobs.
And he said its San Francisco that suffers by protecting people like this weeks target, who had three felony convictions for burglary in 2016, 2017 and 2019.

Excellent.
SF can do nothing about it.
Keep it up.
“Thats a head-spinning headline. Its as if ICE is the one defying the law.”
That’s a good point.
Maybe the feds need to start arresting the politicians across this country who have put sanctuary laws in place.
The feds can just ignore California’s laws and swoop in to arrest any illegal alien anywhere. The Constitution makes it quite clear that controlling the borders and setting immigration law is the purview of the feds.
Sounds like a good bust to me.
He wasn't in the courthouse so what is the beef?
The fault with this scenario is that the ATF wont be brought in to enforce state law.
ICE is merely following federal law which supersedes local and state law.
Correct, those are not laws.
SF has homeless people, in public, reaching into their pants and eating their own excrement.
Their libtard normalcy bias blonds them to the fact they are actively destroying their own city/society.
Correct, those are not laws.
In California, the city councils or county managers decide to make their city or county a sanctuary.
We never get to vote or even have a hearing before their edicts to become a sanctuary.
I think ICE should step up their game and start arresting them in the Court Room in front of the Judge and Bailiff.
No, you have it backward. The Civil War was fought over the Supremacy Clause of the Constitution, which subordinates the states to federal law.
Sooner or later the local demonRAT polls will get the message.
Theres nothing in our Bill of Rights, guaranteeing the natural & inalienable Rights of foreign nationals to break into our country and rape, rob & murder citizens.
Resolutions are not actual laws. They are statements on an issue or event or person.
Same reason blacks have been voting for the dems.
Not a fair comparison.
The 2nd Amendment is Constitutional law. Sanctuary is not.
Yes!
Federal law trumps state law.Pun absolutely intended.
It’s an election year, which means there is pressure on ICE to up its arrest numbers. If you don’t believe me look at the arrest/deportation numbers during presidential election years. Obama included.
“Replace immigration sanctuary with Second Amendment sanctuary.”
Big difference.
Immigration sanctuary is protecting criminal alien invaders.
Second amendment sanctuary is protecting a civil right named in the Constitution.
