A federal judge on Sunday ruled that it was unlawful to appoint Ken Cuccinelli to lead the agency responsible for processing US immigration requests. The judge also invalidated a set of policies for the asylum seekers who are part of the case. Advocacy groups filed a federal lawsuit last year challenging the legitimacy of his role as acting director of US Citizenship and Immigration Services, asking the court to set aside asylum policy changes issued shortly after he took office. Cuccinelli is currently serving as the acting Deputy Secretary of the Department of Homeland Security, which oversees USCIS. The lawsuit argued that Cuccinelli, who took over at the agency on June 10, 2019, did not satisfy the legal requirements to serve as the director under Federal Vacancies Reform Act ("FVRA") and the Constitution.

And the devious Lindsey Graham should do away NOW with the Blue Slip process that DemocRAT senators use to veto good, constitutionalist District Court nominees.

The judge provides cover for Leftist Deep State bureaucrats to ignore President Trump's orders. They cannot be fired for refusing to ignore a judge.
Notice that only works in one direction. Obama was able to ignore judges when it suited him, and the FedGov obeyed Obama.
The lefties keep up this crap, but we still hear constantly about someday they will realize the error of their ways, and start to cooperate in a bipartisan way, and all will be happy forever more.

Ignore it - inform the court they do not have the authority to overrule a Presidential appointment.

F’n outrages, a Judge overruling a Presidential appointment. I have never seen this in my lifetime and I have been around awhile.
Good Lord - idiot judge undertook a literal reading of the law where it says that the vacancy must be filled by the ASSISTANT to the office.
Cuccinelli worked in the office but not as a direct assistant and therefore the judge orders that his taking the job is unconstitutional.

D.C. Circuit sonic has to go through that appeals court which is under D control. Will have to get to Supreme Court before it gets overturned which could take a while.
If Trump gets re-elected and we hold the Senate, it will be yuge in terms of flipping these courts.
Well past the time to start impeaching judges for judicial misconduct and over reach.
