A federal appeals court has blocked the Trump administrations Remain in Mexico policy that requires asylum seekers who attempt to cross the U.S.-Mexico border to wait in Mexico while their cases are processed in the U.S.
The unanimous ruling from a three-judge panel of the 9th U.S. Circuit Court of Appeals stated the policy conflicted with U.S. immigration law. The court blocked the Remain in Mexico policy, originally known as the Migrant Protection Protocols, across the entire U.S.-Mexico border.
Around 59,000 people are currently a part of the program, Customs and Border Protection Commissioner Mark Morgan said on Thursday.
Top immigration officials in the Trump administration, including Acting Customs and Border Protection Commissioner Mark Morgan and Acting Deputy Secretary for Homeland Security Ken Cuccinelli, have defended the Remain in Mexico program as a effective way to eliminate the catch and release statuts quo, in which migrants were released back into the U.S. after being apprehended and instructed to return for their asylum hearing months or, in some cases, years later. Officials have also said the policy works as a deterrent to illegal immigration.
However, in the courts decision Judge William Fletcher criticized the policy as putting migrants well-being in danger.
[The Migrant Protection Protocols have] had serious adverse consequences for the individual plaintiffs, Fletcher wrote. Plaintiffs presented evidence in the district court that they, as well as others returned to Mexico under the MPP, face targeted discrimination, physical violence, sexual assault, overwhelmed and corrupt law enforcement, lack of food and shelter, and practical obstacles to participation in court proceedings in the United States. The hardship and danger to individuals returned to Mexico under the MPP have been repeatedly confirmed by reliable news reports.
I wonder how the SCOTUS feels about this.
Okay, so this is real, it is today? (A similar FR post is dated from last April.
This makes NO sense.
Why doesn’t America have the right (through the President’s organization) to keep people out who don’t belong here???
And the hits just keep coming.
Thats not the US unless you are a Mexican.
Any time now for a reboot. It isn't going to get better as long as the left exists on this planet.
the commie judges are seditious and must be replaced ASAP!
this is an intolerable ruling, absolutely treasonous
This will go to an en banc review before it goes to SCOTUS.
The injunction is very likely to be blocked at the en banc review.
The 3 judges in question are the old 9th.
I didnt get a word right in there:
The only people who areNT allowed to apply for admission are from outside of Mexico, per the UN.
So hearsay and rumor are admissible if it benefits the left.
Let's house those 59,000 criminals on the grounds of the 9th circuit . . . until the Supreme Court overturns this lawless demand of an out of control Obama court.
I thought that they said Trump flipped the court with the judges who decide the cases the other day.
Judge William Fletcher, appointed 1998, by Slick. But don’t tell Roberts he’s a Clinton Judge.
There are entirely too many courts. Which ruling is “final”? What a joke. Trump should just use the ruling that he can ban countries and ban them. System is not a system at all
As I understand it, you don’t apply for asylum at our border.
You are supposed to apply in the first nation you enter outside your own.
Failing to do that, results in people doing it at our border.
These judges have fallen flat on their face here.
No it isn't.
It's a temporary injunction until the case is heard. And it's based on an interpretation of immigration law, not the Constitution.
According to this judge an illegal cannot stay in Mexico because the police are corrupt there. What about the fact that we have better convenience stores and our television shows are much better also?
a ‘so-called’ judge?
In my humble opinion the judge is just helping trump to get reelected.
