New Mexico Goveror Michelle Lujan Grisham signed a red-flag gun bill Tuesday that will allow state district courts to order the temporary surrender of firearms, and she urged sheriffs to resign if they still refuse to enforce it.
Flanked by advocates for stricter gun control and supportive law enforcement officials at a signing ceremony, Lujan Grisham said the legislation provides law enforcement authorities with an urgently needed tool to deter deadly violence by temporarily removing firearms from people who pose a threat to themselves or others.
Some sheriffs from mostly rural areas opposed the bill in committee hearings as a violation of constitutional guarantees to due process, free speech and the right to bear arms. Public rallies were held for and against the legislation.
Lujan Grisham said sheriffs should have the opportunity to oppose any proposed policy change, but "they cannot not enforce."
"If they really intend to do that, they should resign as a law enforcement officer and leader in that community," she said.
New Mexico Sheriffs' Association President Tony Mace of Cibola County said the new law goes too far by potentially impounding guns before any crime is committed and that he and other sheriffs will assert their discretion over its enforcement.

Sheriffs are elected officials. It is better to charge them with aiding and abetting criminals, and whatever else they can come up with.

Any governor not wanting to abide by the U. S. Constitution should just resign.

New Mexico sheriffs unwilling to enforce new red-flag gun law work for their citizens and not for the totalitarian thug who wants the power to order real Americans around. “Shall not be infringed” means exactly what it says.
If there is sufficient justification to involuntarily commit someone who poses a threat to society, then that person should be committed under a court order (and should leave all firearms behind while under psychiatric evaluation). If there is not enough evidence to react at that level, then there is not enough evidence to deprive an American of a God-given and constitutionally-protected human right.
“I’m not refusing, but, as you know, we’re pretty busy here in the sheriff’s office. We’ll get around to it in due course.”

I am of the opinion that State Governors who sign unconstitutional legislation should resign.
States can defy federal immigration laws but counties cannot defy state gun laws.
THE GOV SHOULD RESIGN.
Also, New Mexico has an existing law on the books that assets cannot be seized by law enforcement without a conviction. The Red Flag Law violates that law.
I would say the Sheriffs in this case are following the correct law, and the constitution.

Notice the NM Gov did not say “I will fire any sheriff who fails to enforce my Red Flag law”.
That’s because she can’t; sheriffs are elected and can be removed only for malfeasance in office. Removals are extremely rare.
But as noted, she can f*** with his budget. But that would have to be done in broad daylight.
Two states are setting up dedicated squads whose sole task is to confiscate guns. The risk for them by doxxing would be great; just a few names & addresses to put up on the internet instead of an entire department.
Red Flag governors are discovering that they do not operate in a vacuum; there is a reaction to every action.
I have a buddy who knows a local Albuquerque FFL very well, even works for them part time. He says before the legislative session, they couldn't give away ARs and AKs, and the shelves were full of them.
Now, there are maybe two or three in stock any given day.
