SACRAMENTO (AP) California will consider legislation that would wipe the low-level criminal records of about 2 million people going back decades, part of a lawmakers second attempt to remove barriers to finding work or housing.
The measure is part of a provision that was removed from a bill approved last year that would expunge records of certain arrests and crimes starting in 2021.Its author, Assemblyman Phil Ting, a San Francisco Democrat, proposed the new bill on Monday with the backing of district attorneys from San Francisco and San Joaquin County.
Officials said records like being arrested for domestic violence or impaired driving where charges werent filed could be automatically cleared.In California, arrest and conviction records of lower-level felonies and misdemeanors eligible for probation can be expunged.
Sex offenders and any offender who served time in prison are ineligible. The bill would not change which records are eligible to be expunged.

Just imagine the hysteria if the GOP proposed “automatically clearing” the records of accused wife beaters.
For arrests and misdemeanors, yes. For felony convictions, no.
The nature and context of the offense matter. People who have paid their dues to society in general, deserve a second chance.
But not all felonies can be overlooked.

This part should happen. Bad arrests or arrests where charges are never filed should not be on record. A false accusation can ruin lives.
Yup. Theyre completely irrelevant to any disposition of the facts or character.
On the other hand, if someone served time for murder, rape, armed robbery, domestic violence and child abuse, I would want to know about it.
Liability issues and all. Trust is important and so is the truth.
Sealed from who? I ca understand if arrested and no charges being seal from general public disclosure, but not from police, prosecutors, and attorneys if that person is later in court. Convicted? Always and permanently publicly available.
And unseal divorce records of anyone running against a preferred Democrat.
Civil matters are very different from a criminal record.

I am for this. No sealing felonies or violent or sex offenders, but misdemeanors five years or longer should be eligible.
