Advice for avoiding a perjury trap when confronted with law enforcement. Never waive your 5th amendment rights. Never speak without your legal counsel present. Let your counsel speak for you. Do not sign anything. Had Roger Stone done so he would be a free man now with money in his pocket.
Like I said in my last post ... this is starting to look like the Special Olympics Administration.
The way you present this has to be subtle, as in, "I want to talk to you, but I need to discuss this with my attorney."
Don't outright refuse, or in any way give them a legal excuse to get tough with you. Always keep it respectful.
And NEVER talk to the FBI without an attorney WITH A RECORDING DEVICE.
And before you take my advice, run it past your attorney.
“Never speak without your legal counsel present.”
IMO, just give name and address, verify anything they show you as far as your ID goes and then say I am not answering further questions, unless you want to run up a huge legal bill. DO NOT TAKE THE FIFTH AMENDMENT. Your taking it CAN be used in a grand jury to establish suspicion of guilt. It cannot be used at trial but if you don’t open your mouth they cannot have a perjury trap unless you lie about your ID.
If they give you that song and dance about establishing a few facts, say if they are facts then you have what you need already. If you get indicted for something, you would have been indicted anyway so why give them more ammo??
