Yes, I just heard the same on Fox News (Ted Cruz).

As Cedar Dave said upthread, though: "Watch the Dems try to change the rules so that a tie is unacceptable and votes must be taken until a majority is reached."

Lamar certainly seems to buy in its entirety the Schiff sham, but comes to the right conclusion:

Roberts makes up the rules as he sees fit. If it is a tie, I assume that he will vote “Yes” and declare his vote constitutional. I can’t trust him.

If it is 50-50, it will fail, and that is what he will declare. Roberts has spoken before about the independence of the different branches of govt. That is why Schiff and Nadler spent all night begging the Chief Justice to vote unilaterally on witnesses.
