If Manchin VA and Jones AL vote to remove Trump they are history. Jones may well be history anyway since he is running this year.

You are right that what Trump believed is not admissible to the case, because it is unprovable and unknowable.

But it does “matter” to the point Dershowitz’s was making - namely, that in order to prove the President was not acting in the national interest, the burden of proof would be on the House Managers to prove President Trump did NOT believe the Bidens were corrupt. And since that is impossible to prove, they have no case.

Dershowitz was going a little farther into the hypothetical - arguing that even if it could NOT be proven objectively that an investigation might show that the Bidens were corrupt, or even if it could be proven objectively that the Bidens were not corrupt, the president’s motives still may have been in the national interest, if he believed the Bidens may be corrupt.

Believe it or not, I think you, I and Dershowitz basically agree. He was just taking the hypothetical to another level to show just how absurd it is to try and impeach a President for having a motive that you can’t prove.

WE need to be absolutely SOLID and completely together on this vote NO ONE voting yes, this impeachment must be shown completely partisan and a few Dems coming to our side!! This vote goes into historical archives and these DAMN senators need to get on board PERIOD!!! MITTENS needs to be warned that his life will be miserable in the senate AND if there is a whiff of ANYTHING resembling wrong doing he will be OUTED!!!

It wasn’t that long ago that folks were saying “Bring it on!” for a trial because that would allow the Republicans and the Trump team to do discovery. Through the discovery phase all kids of dirt could be explored, even going back into the Clinton emails.

Why has this fallen away from the discussion?

Also heard many comment that if the President is impeached and acquitted, he could serve out a third term as the first term would be declared compromised and essentially null and void. Is that true, and if so, why isn’t this being discussed more widely?

Schiff might think that's a clever answer, but what he essentially saying is that the House can bring a big bag of dog poop and drop it on the Senate floor, and they have to dig through it to find out whether or not the dog ate their homework.

I really don't think the Senate wants to do the House's dirty work.

Taking it further, some here have suggested that the Democrats insistence on NOT allowing the Bidens to testify IS admission by them that they think he's guilty.

By saying that Trump would benefit in 2020 by investigating Biden is to admit that an investigation into Biden would NOT exonerate him. If Biden were to be exonerated by an investigation, that would benefit Biden and hurt Trump.

Therefore, Democrats blocking the Bidens from being witnesses proves that the President WAS acting in the national interest.

Reality set in. When it was realized that each witness would get an up or sown vote by the senate it pretty much eliminated getting Schiff, Biden and The fake whistleblower.

I haven’t had time to watch everything. Has the argument been made that Joe Biden effectively communicated to the Ukraine that US policy given to him by Obama was that the Ukraine should not investigate the corruption of Burisma, essentially signaling that they should not expose US politicians and their families. Trump effectively told the Ukraine that the previous US policy was no longer in place, that they were free to investigate politicians like Biden without being afraid of what the US would do.

I saw somewhere that Manchin is considering splitting his vote- Convict on Abuse of Power, and acquit on Obstruction of Congress. What a weasel way out. He thinks like Arlen Specter.

"Thanks, it’s a shame these answers really don’t mean anything. The Democrats have made up their mind to vote guilty, in spite of the law or the evidence.

Sending a former social worker and former law enforcement employee to answer Q&A (in this case, fabricate a substandard, non-legal answer) as a quota-driven place-holder in an impeachment trial is indicative of what the Dems think important and is indicative of the level of their cognition (that is, largely from the bases of emotion and optics).

It's an answer he thinks will help him get Feinstein's seat.

The Senate can't conduct other business while sitting as a court of impeachment. This could drag on for months. Some of them want to be POTUS or VPOTUS.

1. Many of us didn't want witnesses from the start because it's the job of the House to do the investigation and it would set bad precedent to allow future Houses to pass the buck to the Senate.

2. Nobody seriously believes a President can get a "do-over" term. There is nothing in the Constitution to allow it. Elections are every four years, and even wars didn't change that.

I disagree. On the Obstruction of Congress article, some Dems will defect, probably about 4 of them. On Abuse of Power you might see party lines, maybe one defector on each side.
