RICHMOND — Both chambers of Virginia’s General Assembly passed the Equal Rights Amendment Wednesday, fulfilling a promise that helped Democrats seize control of the legislature and marking a watershed moment in the nearly century-long effort to add protections for women to the U.S. Constitution.

A federal district court in Idaho (NOW v. Idaho) ruled that the ERA died in March 1979. It ruled that the method used by Congress to extend the ratification window to 1982 was unconstitutional. Attempts to take it to the appeals court and the Supreme Court failed back in the 1980s.

It's dead. The Archivist of the United States will not accept a Letter of Ratification from Virginia.

To revive the ERA, the Supreme Court would have to reverse its 1921 decision in Dillon v. Gloss. which would throw the entire amendatory process into constitutional chaos. This is why the Supreme Court won't touch this case.

It's dead.

We don’t need constitutionally express, sex-related equality protections beyond the voting rights 19th Amendment imo.

"19th Amendment:

The right of citizens of the United States to vote shall not be denied or abridged by the United States or by any State on account of sex."

You’ve obviously missed the forthcoming arguments. We need to disregard states that have withdrawn ratification but credit late ratifies. It’s only fair, or so we’ll be told
