why do we have to keep waiting for them to commit horrible crimes before they are deported? the crime of illegally entering should be enough to kick them out. I don’t care she was a prositute this illegal shouold never have been here to do anything.

Of course. I merely find it reprehensible to believe that deporting him, even if he stayed out, is a ‘solution’. You have a sociopath on the loose, and wherever he is he’ll kill some more.
I’m not sure I agree with you, but they could in theory get his DNA from the fingerprint device. I would guess they don’t use paper anymore - if they did use fingerprint cards his DNA would be on that. If they scan them, his DNA would be on the scanner. Or do I watch too many crime shows?
Don’t know if you can extract DNA from finger prints on something.
I dunno. Cop shows, murder mysteries, forensic files etc tells me that you can extract DNA from the fingerprint card or the scanner slide. But I could be wrong. And besides, if consent is required (as per the judge in this case) then I guess it still wouldn’t be legal to extract it.
Well cop shows and murder mysteries are just that; if you place your hand on a scanner at a cop shop while being arrested you’ve already left your DNA there and like the fingerprints the DNA can be swabbed off as well. (??)

I suppose that’s what I meant. I don’t know if they can get DNA from a finger print itself but perhaps from anything he touched. The fingerprint card, the fingerprint scanner slide - in theory they could have his DNA from his jail cell, clothing, interrogation room table, handcuffs etc. I am not claiming to be an expert at all, just from what I’ve seen on TV. If he lost a hair on his jail cell pillow wouldn’t they have a way to get his DNA?
But I guess the point is, none of that would be admissible? It seems he had to consent to it, and consent to it in his native language.
I am not particularly in favor of assembling a national database of people’s DNA. But it seems almost inevitable. They are pretty much done collecting fingerprints of most of the country through the motor vehicles departments. It’s only a matter of time before they have almost everyone’s DNA. And, beyond DNA, facial recognition software etc. The libertarian in me finds all this a bit scary. But I don’t like seeing murderers walk free at all. On a stupid technicality. I didn’t read too much about this case but why does his consent have to be in Spanish? Did they even establish whether he understands English well enough? People come to this country from all over the world. 100+ languages. If a person is told point blank “you have the right to remain silent” in their native language, it is hard to imagine they don’t really understand it. People know their rights. The American system is pretty ubiquitous. Plenty of dumb-ars Americans, native English speakers, willingly give up their rights and get sent to prison. I don’t know that this minor technicality is really justice.
