NY Reform Laws Force Prosecutors To Give Victim Names, Contact Info To Criminals

Albany, NY – Under New York’s " justice reforms," criminals must be provided with the names and contact information of victims and witnesses involved in the case against them.

Effective January 1, 2020, prosecutors will have just 15 days from the time of arraignment to hand over all evidence pertaining to a case – including victim and witness information, WSTM reported.

Cases can be dismissed if prosecutors fail to meat the deadline, Albany County District Attorney David Soares told the news outlet.

“’By the way, I have to provide your cell phone number to his lawyer in a few weeks,’” Soares used as an example of what he will be forced to tell crime victims. “I don’t know how I’m going to have these conversations with a victim.”

Under the law change, the court can also require crime scenes to remain unchanged so that defendants can be allowed to visit them, the New York Daily News reported.

Staten Island District Attorney Michael McMahon has been speaking out about the myriad of problems the sweeping changes will have throughout the state since they were passed back in April, the Staten Island Advance reported.

“We will undoubtedly see a chilling effect on cooperation by those impacted by crime, choosing instead to protect their own privacy and avoid being re-victimized,” McMahon warned. “While there certainly was room to improve New York’s criminal justice system, the ‘reforms’ to our bail and discovery statutes supported by our state Legislature and Governor Cuomo blew past any semblance of fairness or justice.”

Soares noted that some aspects of the law changes are essentially impossible to comply with, such as being mandated to turn over DNA or toxicology results that won’t even be back from the lab within the 15-day period.

“You have the right to face your accuser (and any testifying witnesses) in a court of law.”

Imagine if you are accused of a crime and never get to know who your accusers are till you go to trial!

How do your lawyers mount a defense?

New York and California seem to be in a struggle to see who can enact the most ridiculous laws.

Both states have effectively seceded from the union and possibly from civilized society.

The inmates are in charge, Virginia is following closely behind.

Insane. There were no good intentions, it’s all about DeBlasio and his idiot wife trying to court blacks, whom they seem to think want to live surrounded by crime and seeing their kids shot to death every day by criminal kids in their neighborhoods. The only people who want that are leftist black Dem politicians, but that’s okay because they hire the school busses and get the grannies out to vote for the leftist Dem. Since NY is a one-party town and state, you only get a choice between left and lefter.

The victims of this law are going to be black people. The thugs in these neighborhoods have freely been posting “snitches get stitches” to prevent witnesses and even victims from appearing in court,. But now that the City of New York has affirmed the thug policy, look for things to go from moderate hell to major hell in black neighborhoods, where everybody is terrified of the thugs.

That’s a fair point. Defense attorneys should always have the opportunity to question the accuser (and any witnesses) well before the trial starts.

Just how to best do that I don’t know. I’d have no problem giving the defense attorney contact information. But I sure wouldn’t want that information to become public knowledge.

Depositions in the DA’s office of the accuser by the accused or the accused’s lawyer are possible.

Written interrogatories are also possible.

This is part of the master plan to disarm everyone but criminals. Make it hard to get a gun, move illegals to the mainstream, release criminals without bail, now release your name to the criminals for retaliation. Stir and let simmer and you will have citizens clamoring for a type of Martial law.

Oh , But the journalists will find it easier to write the stories about the victims, and be able to publish addresses and numbers, since it’s all now public information. I wonder if video rentals of Death Wish V with Charles Bronson will go up. So if someone is in witness protection and the prosecutor doesn’t provide the name and address will it be cause for dismissal?
