Feldman isnt trying to help the President. He knows the Senate can acquit immediately without waiting for Speaker Pelosi to transfer articles of impeachment, or for House impeachment managers to be appointed. This is because the Supreme Court has ruled in the Nixon case that how the Senate goes about acquitting or convicting any impeached person is non-justiciable, in that the Senates power is plenary and the Supreme Court may not even review it. This means that if the Senate acquits Trump immediately without a trial the Supreme Court has no authority, whatsoever, to review the Senates acquittal, and there isnt a damn thing the House can do about it. Feldman is distracting the nation from understanding the full scope of Senate acquittal authority. He knows that if the House hasnt impeached the President, the Senate could not immediately acquit him. This is why Feldman appears to be defending POTUS.

Pease provide an affadavit from your friends attesting to your claim
I expect that Mitt has at least one or more friends than Mitch wants him to have right now. As soon as enough of those friends get what they want out of Mitch, things could move on...
He’s letting Nancy and Chuck dig their holes deeper and fill them with black sewage...Trump has given him a thrill of a lifetime and he’s savoring it.
Mitch knows. Its more fun to let Nanzi twist in the wind though.
The same ruling indicates, without directly saying it, that the senate can simply ignore it.

Exactly. Pelosi is like some crazed girlfriend who’s sh*t testing Mitch by throwing a tantrum. Best way to pass the test is to ignore her behavior and in this case ignore treating their impeachment as anything ohter than the farce it is.
By not jumping and counter-responding to Pelosi, Mitch gives Nancy *nothing* to whine about. She’s stuck in a situation of her own making.
51 Republican votes, which he might not have, thanks to Romney, Colins, etc.
Pelosi knew all along that there would never be 67 votes to convict. But anything less than 51 votes to acquit would be damaging to Trump.
No. Presidential impeachment requires a supermajority to convict
I like that... Trump Republicans.
In the future, we will have candidates announcing that they are Trump Republicans, taking the place of candidates who used to claim to be Reagan Republicans. Awesome!
Really it means unabashed nationalism.
That is one person’s opinion...so what?
Trump Isnt Impeached Until the House Tells the Senate
Noah Feldman is a Bloomberg Opinion columnist. He is a professor of law at Harvard University and was a clerk to U.S. Supreme Court Justice David Souter. His books include The Three Lives of James Madison: Genius, Partisan, President.
Yes, this circus needs to end, this hand wringing with Democrat demands. We all know what democrats would do, ha!
I LOVED Reagan but I have to say that Trump has been a much better POTUS, Trump is a little rough around the edges HOWEVER his achievements and FIGHT far out weigh what Reagan did!! I will also NEVER forgive Reagan for the whole amnesty debacle the illegal immigration situation today is destroying our country BECAUSE Reagan never got that damn border secure AFTER giving the amnesty!!! The long term effects that has had on the demographics of our nation can NEVER be reversed AND it is totally changing the foundation the nation was built on!!!
I just saw Turtle on Fox & Friends and he is NOT planning on going forward with anything until he gets the articles, I wish he would just dismiss the whole damn thing!!
None of them except maybe Jim Jordan want Trump in office.
Thats not true. Not even close.
There were a lot of anti-Trump Republican lawmakers in 2016, but they had diverse reasons for it, and many of those reasons no longer apply.
Lets look at a few of the complaints.
He wasnt a real Republican - he had a history of supporting Democrat campaigns as often as not. Republicans doubted he would be loyal to the party.
He wasnt a real conservative - he had no political history to indicate that he shared the conservative principles of the traditional Republican platform, such as limited government, free enterprise, 2nd Amendment, pro life, military strength, and constitutional judges.
He was a billionaire celebrity talk show host - not a serious candidate - he had no chance of winning and he would drag the Republican Party down with him.
His political incorrectness and unpresidential manner were an embarrassment and would destroy the Republican brand.
His personal attacks against the Bushes, Cruz, Romney, McCain, Graham, Ryan and other Republicans during the primary campaign left him with powerful Republican enemies.
Three years later, most of those concerns have been completely disproven - he campaigns fiercely and effectively for Republicans, he champions conservative causes better than any Republican President ever, except perhaps RR. He proved that he is an unparalleled winner despite being new to politics. His political incorrectness and unpresidential style have not hurt his popularity or dragged the party down - his approval numbers are quite respectable.
There may still be some grudges held by Romney and other butt-hurt or envious Republicans, but Graham, Cruz, and many others seem to have put it behind them. Outspoken neverTrumpers or Trump doubters in the conservative media, like Levin, Limbaugh, Bennett, Preager, have come full circle in support.
Sure there are some compromised, deep state Republicans who really dont want the swamp drained - but their numbers are wildly exaggerated by some here at FR.
Republicans, like most politicians, will abandon a sinking ship - but President Trump is anything but a sinking ship.
They will support him - you will see.
Says who? The only thing that even mentions transmittal of the impeachment are Senate rules - which the Senate alone can change.
The impeachment vote was recorded and verified. That is the critical factor to get into court.is the court for purposes of impeachment. There is absolutely no legal or constitutional impediment for the Senate taking judicial notice of the publicly recorded fact of impeachment, and proceeding accordingly.
It’s a game on both sides for the public.
Trump wants a trial but Mitch does not. Too many Deep State secrets would be revealed.
Maybe Senate rules?
Sec 1 of Senate rules on impeachment require the transmission of the articles to the Senate and the naming of managers to the trial.
The Senate must first vote to change its own rule before it can do anything else. This is a simple majority vote-—but it is a Senate rule.
If impeachment is not recognized because Pelosi does not send the impeachment charges to the Senate, the Senate should hold an impeachment trial with an exact duplicate of the House’s fraudulent charges and then vote to dismiss the charges with prejudice.
