Will Nancy Pelosi’s Gambit to Withhold Impeachment Charges From the Senate Work? (IMPEACHMENT HELD HOSTAGE - DAY 2)

On Wednesday, after the House of Representatives impeached President Donald Trump for abuse of power and obstruction of Congress, Speaker of the House Nancy Pelosi addressed the next steps in impeachment. Normally, this would mean the transmission of the charges to the Senate by House managers acting as prosecutors. Instead, Pelosi said that the House would not appoint managers and send the charges to the Senate until it knew what the trial would look like. Pelosi then went even further, suggesting that the charges might not even make it to the Senate.

“We will make our decision as to when we’re going to send it when we see what they’re doing on the Senate side,” Pelosi said when asked if it was possible that the House might never send the articles to the Senate.

The move to postpone the transmission of articles of impeachment comes after a proposal in the Washington Post on Monday by Harvard Law professor Laurence H. Tribe about “holding off for the time being on transmitting [articles] to the Senate.” Tribe argued that such a move would “strengthen Senate Minority Leader Charles E. Schumer’s (D-N.Y.) hand in bargaining over trial rules with McConnell because of McConnell’s and Trump’s urgent desire to get this whole business behind them” and would be justified because McConnell’s outlined plan would “fail to render a meaningful verdict of acquittal” and “fail to inform the public” about the full extent of Trump’s wrongdoing.

On Wednesday afternoon, the Washington Post and Politico reported that a sizable group of House Democrats were on board with Tribe’s proposal. House Majority Leader Steny Hoyer told Politico that colleagues had raised Tribe’s article with him as a possible avenue for Democrats.

It won’t work. If there is a Senate trial, Trump can only be declared not guilty, or guilty. Since he is innocent until PROVEN guilty, the Senate can declare “If there is no trial, he is INNOCENT!

This guy needs a rubber room.

Mitch doesn’t have to negotiate ANYTHING with Chuckles. You know another way to “get the whole business behind them”? Do nothing and let it die on the vine. People are already talking about other things.

Mitch and Trump don’t NEED a trial at all. This is what these clowns don’t get.

Who cares? If the Senate wanted to it could take this up tomorrow with or without the House. But while Queen of all she doth survey Pelosi holds onto those, they get stale, look non-urgent and pretty much continue to hurt the democrats.

Meanwhile, the Senate keeps on keeping on confirming judges and Cacaine Yurtle is having a good time.

Pelosi obviously isn’t doing this as a negotiating tactic, because everything she says only serves to piss off McConnell even more. Importantly, it pushes any RINOs in the Senate to stand firmly on his side.

Once again , negligent in carrying out their duties as elected representatives, instead relying on a non elected person to render a decision.

To me thats Roberts duty as overseer of the process, of course he will defer to Congress as he is a weasel...

Wonder if they are holding this to wait for the Supreme Court to rule on the outstanding executive privilege claims. If they get a favorable ruling they will claim they need more time to investigate dragging this out into the actual election and sparing their congress presidential candidates from being drug away from campaigning...

The Senate should turn the tables. Use the same rules as the House but this time, reverse the roles. Force the House / Pelosi to defend their lopsided partisan attacks.

The Constitution does not grant the Speaker of the House the authority to delay the proceedings of an Impeachment. Once an impeachment vote has been passed, the Senate is obligated to take up the charge.

Tribe is a POS. But in this case, he is right. There is no impeachment unless the articles are presented. However, the Republicans can make the case that they have been presented because they were published, if they want to proceed with a trial. I would almost prefer that McConnell not address the lack of the presentation of articles and let it die on the vine, but in the next breath, announce an investigation into Biden and Ukraine (on the basis of a ‘pre-impeachment’). They can make up poo as well as the democrats..

Fine, but I don’t care about the technical rightness or wrongness of that. My view is never doing anything with this is just as fine for Mitch and Trump as having a quick trial and dismissing it. They have no incentive to ‘negotiate” with any Dem about anything. Trump will just use what the Dems have done to his advantage.

That’s what I’m arguing for if the Dems think a strategy of holding things back will make the GOP do what they want. It won’t. Screw ‘em.

What they could be waiting for is for the Court to rule in their favor, compel the witnesses to testify and then vote ANOTHER Article of Impeachment against Trump.

The problem is, obviously, this is in Federal District Court and is subject to appeal to the Supreme Court, which cold delay any ruling until well past the 2020 election.

The Administration could argue the subpoena’s are moot, since the House already voted Articles without testimony, but the document request could be more far-reaching.

Remains to be seen.
