Judge blasts FBI over misleading info for surveillance of Trump campaign adviser

The secretive federal court that approved the surveillance of former Trump campaign adviser Carter Page on Tuesday accused FBI agents of creating a misleading impression about their basis for requesting a warrant and ordered the bureau to overhaul its process.

In a blistering order, a judge on the Foreign Intelligence Surveillance Court (FISC) accused the bureau of providing false information and withholding materials that would have undercut its four surveillance applications.

"The FBI's handling of the Carter Page applications, as portrayed in the OIG report, was antithetical to the heightened duty of candor described above," Rosemary Collyer, presiding judge with the FISC, wrote in the order released by the court.

"The frequency with which representations made by FBI personnel turned out to be unsupported or contradicted by information in their possession, and with which they withheld information detrimental to their case, calls into question whether information contained in other FBI applications is reliable," Collyer wrote. "The FISC expects the government to provide complete and accurate information in every filing with the Court. Without it, the FISC cannot properly ensure that the government conducts electronic surveillance for foreign intelligence purposes only when there is a sufficient factual basis."

Maybe notin prison.but probably dead. How many leads were ignored while the FBI was hatching this insurance plan.

When they discover a police officer lied in a report, fabricated evidence, or changed evidence, they make sure they review every arrest he/she made. You'd think with all the deliberate violations the FBI made with the FISA warrant applications, that each and every FBI case that any of these people played a part in, would be reviewed for similar investigative violations.

Here's the 800 pound gorilla in the room, and I think the honorable judge is somehow not seeing it.

The people involved in the FISA applications weren't common people suing each other over small claims because they had a minor accident and they are blaming each other.

The people involved are lawyers and/or top law enforcement officials who knew, or should have known, that they were engaging in criminal activity. ALL of them know that false statements can result in substantial prison terms. Many of them have sent people to prison for far less that what they have done. The judge, if she were to be on the side of justice, should be holding people in contempt, and banning them from further appearances in Federal and State courts. The judge, if she wants to be on the side of justice, should personally appoint a special prosecutor.

I forget which case it was, but a couple of years ago a Federal Judge ordered DOJ officials to take remedial courses in ethics. Can something similar be done here? This situation screams for it.

The Judge here is part of the coverup. The process is fine. These guys LIED to the court.

Following leaked revelations that former FBI lawyer Kevin Clinesmith manipulated evidence to attain a Title-1 surveillance warrant against U.S. person Carter Page to conduct political espionage against the Trump campaign, former AAG Matthew Whitaker discusses the IG investigation and upcoming IG report.
Whitaker notes the bigger issues are how the FISA process generally has been abused and potentially long-term ramifications.

It is also worth remembering it wasn’t just “wiretaps” that were gained, the FBI requested and received full Title-1 surveillance authority including:

The purpose of the FISA court is to make sure American citizens aren’t spies on unlawfully by our law enforcement and intelligence agencies. When presented with proof that our law enforcement and intelligence agencies abused that court to unlawfully spy on American citizens a judge wrote a CYA letter saying how disappointed she is and asking the FBI to never get caught again, basically.

FISA court is now being used to subvert the very purpose of the FISA court and it should therefore be disbanded, as should the FBI.

Carter page was never charged. He was never incarcerated. Thus doesn’t need release. He has pending civil cases pending.

I believe you are thinking of General Flynn. He is pending sentencing but is not incarcerated Judge in Flynn’s case is circling the wagons for the FISA Judges. Roberts is in hiding. Judges never responded for almost three years until yesterday.

Excuse me, but the whole idea of the FISC is, itself, antithetical to our entire system of government. You have a secret court, reviewing information provided by an investigatory agency that is an arm of the prosecutorial arm of the government, and issuing warrants as a result. What happens when there is (inevitably) a bunch of made up assertions? Does the accused, and everyone charged with a crime or pressured as a result, get their cases dismissed and their legal fees reimbursed? Do they get their lives back? No, of course not - because we are no longer the Republic that our Founders created, we are an oligarchy run for the interests of those in and around the permanent government.

Oh, so the judge blasted the FBI? BFD! That has no teeth whatsoever. People, LOTS of people, need to go to jail for lying to the Court - starting with one James Comey, who signed at least three of those applications. Of course, I won’t hold my breath waiting for that to happen - because it won’t, any more than Hillary is paying a price in jail for her THOUSANDS of violations of the laws of this country.

I seriously question whether the citizens of this country owe any duty or allegiance to this government - because the government is no longer of, by and for the People, it is an empty shell of what it is supposed to be - a shell maintained to deceive and rule over the people. All that we need is for 5% of the people to withhold their consent to being ruled, to go about their lives as free people, and the government will collapse...and it shouldn’t be 5%, it should be 25% or more.

I am COMPLETELY disillusioned - we can’t even punish government agents who blatantly violate the law. Any of us would be serving the rest of our lives in prison, and would be driven to bankruptcy before being convicted.

Yeah....apparently no one in DC does.

Yet, Comey gets away with claiming procedures were ‘sloppy’?

Full CYA mode has begun. FISA court knew this shi7 was bogus within weeks, maybe even when presented in the first place.

What kept them out of the mix months ago, when it might’ve done some good and spared the country a ton of grief?

I guess since Graham threatened to shut down funding for the court, this crook finally decided to chastise the FBI. Not like anything will come of it. Everyone has known for years that the court was lied to, but apparently the court is very “for” spying on Americans using secret courts.

Is it GWB that we have to thank for this Soviet Style court system?

If you or I deceived a court, we’d be held in contempt if not charged with conspiracy to defraud the courts.

The FISA court simply issued a slap on the wrist to the FBI.

The judge finds it troubling. I find it troubling we have secret courts in this country. The only secrets in this country are information withheld from the people. The Russians, Chinese, Iranians, Israelis, Brits, and every other country that is spying on us knows everything they want to know about the operation of the US government.

End the secret courts now. Keeping them only tempts the tyrants to do dirty work in the shadows and behind closed doors.
