I always thought that people crossing an international border (the US border at least) had very few rights regarding "privacy".But even if I'm wrong on that,which you're clearly suggesting (are you a lawyer by any chance?), I was in a hurry and I strongly suspect that if I had refused to answer he would have sent me to "secondary" and thus detain me for a couple of hours (as Canadian border guards did to me about 10 years ago).

Oh well...live and learn.

I find the following phrases very useful. “Are you a law enforcement officer acting in your official capacity?”>{? “I do not answer questions from law enforcement, agents of the state, or the press without the presence of my attorney.”

Yeah, it's a little irritating when pulled over knowing they are giving driver licenses to illegal aliens, "Where ya from? Where ya going"? Have anything to drink today......"?

The police can and should ask any question they want and I can not answer as many questions that they ask.

f he would have bothered to learn about our country he would have realized “Never Talk to The Police”.

I was pulled over and ticketed for not coming to a full stop at a stop sign - at 5 am, not another moving vehicle anywhere close. I was guilty So I went to traffic court to pay my fine. The citation included a quote completely fabricated by the cop. It was not even close to what I said

I’ve been to traffic court so many times, I can’t remember. I could write a book. ;)

Similar story: I was re-entering the US from Langley, BC at the Lynden, WA crossing. I had entered Canada three days earlier at the same location and did so w/o my passport.

I gave the Border Guard my AZ. driver's license and explained the situation. He punched some info into his computer.

"How long at this address?"
"Five years"
"What was your previous address?"
I gave him my California address of 20 years.
"You want to guess again?"
"What?"
"You had a different residence after the California address"
"Oh, that? I don't know it. I know it was on Hayden. We only lived their 6 weeks while our house was being finished"
"OK. Go ahead and next time bring your passport."

That is just a minor example of how quickly they can find out anything they want about us.

I agree with you and had this case been about that I would have been in favor of the ruling. However, it was not and I do agree with the cop.

Where I have been and where I am going for someone like me in a traffic stop is only my business. Name, rank and serial number are all that are required in such cases. I am a citizen free to move about the country so far and I will not be treated like a commoner.

Which is why I don’t answer questions-and why I have a front and inside facing dash cam. I would also record all conversations with law enforcement. Most are good-but some can’t be trusted. Many have gotten out of tickets for not wearing seatbelts when they really were because of those dash cams that face inside the car. That’s why I have one that faces towards me and also records my speed.

Typical CNN bitching about discrimination which they fail to support.

Otherwise this is a great decision, and should be adopted by the U.S. Supremes. Until then the phrase “I’m not going to answer questions which don’t pertain to your reason for stopping me” should be on everyone’s lips.

You don’t have to be a US citizen to legally drive in the US. If you are a tourist or have some other valid visa that allows you to enter the country as a visitor, you can drive on the license from your home country. If you legally reside in the US but are not a citizen, then you have to get a license in the state where you reside.

Reminds me of the time my husband (then fiance’) crossed into Canada with our sons (both under 15) and my college roomie’s daughter and her boyfriend in a rented van... DL’s handed over: NY, 2 TX, OK. Birth certs for the boys - NY & TX. Canadian says: “How do you know each other?” LOL! I started explaining... he waived us thru.

I also got pulled over for a rolling stop sign in a town of 100 people at 2 am with no other moving vehicles anywhere near. I was guilty too and as the cop was writing the ticket he asked for my phone number, I politely declined to give it to him. When I showed up for traffic court the cop brought that up to the county attorney in charge of prosecution who berated me for it. I told him fine, but I’m still not giving you my phone number.

There’s no reason they need my phone number. Is it a requirement for a driver’s license now that someone have a phone? They have my address from the license so they can get in touch with me that way. If you’re going to write a ticket then fine, do it, but a cop doesn’t need to know any more of my personal business than what he’s already got access to. They not going to become my buddy and call me to discuss the latest football game.

Right decision for the wrong reason. It should not be because more Black or Latin men are asked irrelevant questions. It should be because such questioning being unreasonable if the police only asked them because of a traffic violations.
