On Wednesday, during Fox News Channels special coverage of the Judiciary Committee impeachment inquiry hearings, Fox News legal commentators Andrew Napolitano and Andy McCarthy took a critical look at George Washington University law professor Jonathan Turleys argument against impeaching President Donald Trump.
Napolitano said, Where I disagree with my dear friend, Ive worked with him and testified alongside him, Jonathan Turley, on the significance of obstruction of justice, he is forgetting that the House has the sole, s-o-l-e power of impeachment. It does not need to go to a court for approval. It doesnt need to get its subpoena enforced. When the president receives a subpoena, Mick Mulvaney, Mike Pompeo receive a subpoena, and they throw it in a drawer. They do not comply or challenge because the president told them to, that is the act of obstruction. Jonathan Turley has argued that the Congress needs to go to court and get an order to enforce the subpoena. And the failure to comply with that court subpoena is obstruction. That is a misreading of the obstruction statute

If the Exec Branch claims Executive privilege, Congress has to go to court. Moreover, I’m of the opinion that we need to expunge the concept of obstruction of justice when there has been no actual crime.
Who is this Napolitano guy anyway? I don’t follow him, never did.
He’s getting his 5 minutes of airtime each day which is all he craves. He’s auditioning for his future employment at CNN or MSNBC.
Inquiring minds want to know: Has anyone ever seen Judge Nappy and Matt Drudge in the same picture together? If not, hmmmm....
What Nappy is forgetting is Turley agrees the House is the arbiter of impeachment — but stated that the partisan impeachment effort with literally no facts to support it would be an abuse of that power.

Obstruction of the House of Representatives isn’t obstruction of justice.
We have three co-equal branches of government.
If the President has to obey congress then the Exec is a lesser branch. But is not. It is equal to the legislative branch. The third branch (judicial) is the tie-breaker.

Do Napolitano and McCarthy actually think that Trump has committed an impeachable offense? I get the feeling that they are looking at the procedural aspect as opposed to the actual “crime” itself.
If they do think that, then I’m surprised about McCarthy. I thought he was smarter than that. Not surprised by Napolitano.
