A top Navy SEAL officer is defying President Donald Trump’s defense of Chief Petty Officer Eddie Gallagher by sending his controversial case to a military review board which could result in his ultimate expulsion from the SEALs.
On November 15 Trump reversed the demotion of Gallagher, a Navy SEAL who acquitted of murder this summer, and restored his title of Chief Petty Officer. The president also pardoned two other officers jailed for war crimes as well.
Trump’s grant of executive clemency has been harshly criticized over violations of international humanitarian law.
Despite the Commander in Chief's pardon, Rear Admiral Collin Green, the head of the Navy Special Warfare Command, is taking the matter before a military board.
'This is a review of their suitability to be a SEAL,' an unnamed Navy officer said to CBS News, adding the review has the backing of both the secretary of the Navy and the chief of Naval Operations.

The CinC restored Chief Gallagher’s rank. The RAMD is not disputing that. He is directing an administrative action of review of Gallaghers fitness to serve as a SEAL over other actions he allegedly did in violation of the UCMJ/Laws of Naval Warfare. Why does the one seem to make everyone loose their heads over the other?
If this all political BS, then fine. I just don’t think the POTUS has to be looked at as the savior of every man in uniform that falls under the crosshairs of military justice.
You guys do know that sometimes warriors in uniform F up, right? They deserve justice, not an intervention by the POTUS.
Some deserve Leavenworth, others deserve medals. Second guessing every action of the brass by the CinC will not help the military.
Scrutinizing the brass for their performance will, however, strengthen the force overall and over time.

Having reviewed as much as was made public about Gallagher's charges, it's clear that this was prosecution was an Obama Era travesty that never should have happened and that Gallagher did nothing wrong.
Any honorable review board should exonerate him and restore his good name but given the participation of officers who have have run this with hunt that is not likely.
What Trump should do on this is let Green be Green.
If Green does the right and honorable thing and rehabs Gallagher then great.
If Green wishes to continue this farce and further persecute this innocent soldier he should be dealt with appropriately, probably for conduct unbecoming and insubordination.
If this ends up being more vindictive Obama era persecution of a good soldier Green should be made an example of

Actually, unless the laws/regs have changed in the last decade, 24 MOS TIS/TIR is required for retirement at the last rank/grade held.

As a 32 year retiree and knowing very little about the specifics here - I tend to agree with you. There are a lot of people weighing in here who don't know how all of this works. The POTUS doesn't get to decide who gets to be a SEAL - nor should he. I wouldn't want Obama or Hillary deciding that.

A staff review is in order for Gallagher. There still is some question of his suitability for any particular assignment that needs to be resolved, regardless of his pardon.

The message is clear, the Military doesn’t need Men that fight they need Men and Women that are sensitive to the needs of others.
Persons that show their caring and compassion in all matters.
Soldiers of diversity and inclusion who are not afraid to cry and wear their feelings on their sleeve.

There is possibly another explanation beside just TDS for everything that is going on. Has more to do with the swamp.
Speaking of BS...this guy was in jail and just beat a murder rap! It is highly unlikely he can qualify for SEAL status, and this RADM knows it.

They’re not trying to. An MEB is not a criminal determination. In this case it is to determine the fitness of a military member’s behavior. It can cover anything from physical problems to psychological and are used all the time for those determinations. If a member is unable to operate within the guidelines of the mission needs and can harm it in some way, he/she can be relieved of duty and possibly discharged not for punishment, but like a divorce for incompatibility.
Trump’s pardoning of violation of duty by a military member doesn’t mean the member didn’t do it. It actually cements it. But just because he is not going to be punished for the crime, it can, and does in this instance, create a question as to the fittability of the member. So the board is called after the determination of court martial. It would have been called anyway, probably in his defense to prove incompatibility, if the POTUS hadn’t pulled the plug on further punishment.
To be honest, Trump didn’t do him a real favor by pardoning the crime which left the violation in the works. It was going to follow him for the rest of his career and make it hard for him to get requested warm fuzzies like special assignments or base of preference. The buttons behind the game are pushed by many and often.

Don’t get y’all’s panties in a bunch. This is what happens anytime there is a lack of confidence in a frogman’s ability to do his job. It’s administrative more than anything and is outside the scope of the President’s pardon. If his team mates believe he is no longer an asset, they’ll toss him. I can’t see him staying in the teams. Way too much drama and too many burned bridges.
The military brass think of Trump as a short timer and the coupist Uniparty as their masters.

I’ve briefed a lot of admirals. They can certainly be arrogant.
His rank was saved, but his remaining a SEAL was not. Guys get bounced from the teams all the time.
I have serious questions about Esper. He personally met with and argued against the President granting the pardons. Then he says no action better take place against Vindman for his mutiny (leaking the classified telephone call) against the President. Not until the Greens and Vindmans of the world get stomped on will this insubordination and mutiny in the military ranks cease. They are obviously emboldened by others seemingly getting away with treason and nothing happens.

You are right. I think it was Obama who appointed General Shallikashvilli (??sp) Chairman of the Joint Chiefs that really raised my eyebrows. A guy from an Eastern Block country that spoke broken English Chairman of the Joint Chiefs??? Are you serious????? It seems we have some serious allegiance issues in our Congress, the bureaucracy and the military. It is critical that the Swamp be thoroughly drained!!
