A top Navy SEAL officer is defying President Donald Trump’s defense of Chief Petty Officer Eddie Gallagher by sending his controversial case to a military review board which could result in his ultimate expulsion from the SEALs.
On November 15 Trump reversed the demotion of Gallagher, a Navy SEAL who acquitted of murder this summer, and restored his title of Chief Petty Officer. The president also pardoned two other officers jailed for war crimes as well.
Trump’s grant of executive clemency has been harshly criticized over violations of international humanitarian law.
Despite the Commander in Chief's pardon, Rear Admiral Collin Green, the head of the Navy Special Warfare Command, is taking the matter before a military board.
'This is a review of their suitability to be a SEAL,' an unnamed Navy officer said to CBS News, adding the review has the backing of both the secretary of the Navy and the chief of Naval Operations.

Green sent the letter amid a number of high-profile scandals involving SEALs a community of elite operators numbering less than 2,500 personnel among a force of more than 437,000 active-duty and reserve sailors. The existence of the letter was first reported by CNN's Barbara Starr.
And despite the acquittal of former SEAL Chief Eddie Gallagher on murder charges in early July, his court-martial revealed that members of his unit, SEAL Team 7 Alpha Platoon, constructed their own rooftop bar in Iraq and engaged in other alleged misconduct on deployment.
"We are looking hard as a learning organization to self assess to see, are we assessing and selecting the right people? Are we holding them accountable to standards of honor, courage, and commitment?" Green told the audience at the West 2019 conference, in response to a question from Task & Purpose in February.
Green's acknowledgement that there is indeed a problem stands in stark contrast to a March report to Congress from Special Operations Command, which found there were no "gaps in the administration, oversight, or management of ethics programs or professionalism programs."
The President has the authority to directly appoint officers in the Military. Below the “Flag” rank (Generals and Admrils), there is no congressional review. So President Trump could directly appoint Gallagher to O-3 or O-4, direct that he be assigned to some “retirement” job at some small base or station near where Gallagher plans to retire.
If Gallagher holds that rank for 12 months, he would retire with that rank and paygrade ... not as an E7.

Totally agree. In this regard Trump is still living in a fantasy world where he truly believes everyone will come together for the greater good.
As we have seen, over and over, with Russia, and Ukraine, they mean to kill him. How this fact continues to escape people astonishes me.

When I saw Gen Shinsecki, the dont ask/dont tell Clinton policy and watched what all he was about and thinking about Patsy Schroeder crying all the time about how awful the military was, Ive been considering what has happened under even Ws watch.
Many of these leftys in the JAGs and also top officers behavior, especially when under Pres. Trump, toothless Mad Dog Mattis refusal to enforce the expulsion of LGBTQXYZ, non-response to an order from the Commander-in-Chief, I realize that there is also a very large, if not larger swamp at the pentagon!
Just my non-military opinion here but I havent at all liked what Ive been seeing from the top brass at all.

Part of me thinks this whole story is a workup over nothing.
As much as it can be spun as a defiance of the CiC, the Sailor was convicted of a crime (albeit one that would have been swept under the rug or an article 15 otherwise), and the SEALs are not a unit where convicts get assigned. Service in a special mission unit is not a given, and can be revoked if the servicemember is no longer capable of meeting the standards of service within the unit.
Trump could order the board to disregard the criminal trial in their evaluation of his performance as it was already reviewed by him and other senior military officials and found to be inconsequential in affecting his return to the Teams. If he was a bad SEAL, the rest of his service record and testimony from his teammates would show it, not just that one incident.
