Adam Schiff Will be Called as a Witness in Senate Impeachment Trial: Graham

House Intelligence Chairman Adam Schiff (D-Calif.) will be called as a witness in a Senate impeachment trial, which will be held if the House votes to impeach President Donald Trump.

Sen. Lindsey Graham (R-S.C.), the chairman of the Senate Judiciary Committee, said he’d call Schiff to testify during an appearance on Fox News’s “Hannity” late Nov. 13.

Graham also said he wouldn’t let a trial of Trump be based on hearsay evidence alone. A trial would also not be held if the whistleblower doesn’t testify, he said.

“Let’s say they get 218 votes. Here’s what I promise the country. We’re not going to try the president of the United States based on hearsay. So any resolution setting up a trial in the Senate, I’m going to make sure that hearsay cannot be the basis of an impeachment allegation,” Graham told host Sean Hannity.

“If you invoke the hearsay rule, what would be left?”

“A trial in the Senate, to me, should not legitimize what’s going on in the House. No American is denied the right to call witnesses on their behalf, except for Donald Trump. No American is accused of wrongdoing anonymously, except Donald Trump. What they’re doing in the House is a danger to the presidency itself,” Graham continued.

“So any trial in the Senate needs to make sure that you can’t impeach a president based on hearsay, because that’s a danger to the presidency itself. And secondly, any trial in the Senate must expose the whistleblower so the president can confront his accuser. I will not accept a trial in the Senate until I know who the whistleblower is.”

A trial in the Senate is held if a president is impeached by the House. The trial is presided over by the chief justice of the Supreme Court. If the Senate convicts the president, he is removed from office; if it does not, he remains in office. No president has ever been convicted of impeachment. Conviction requires a two-thirds concurrence of those present.

I’ve been encouraged by Graham since McCain died, but then it was pointed out that he is up for reelection, and he promised to hold hearings, and hasn’t kept that promise. So now he’s got to repeat those promises in order to get reelected. I’m starting to get suspicious...

We - I have gathered more brethren.

We put them on menus, bathrooms, the aisle in grocery stores, gas pumps, etc.

It is a kick to see people actually get as excited as me to do it.

That really is funny!

Why not go to a local book store and put them smack dab in the middle of page 1 of books written by Liberals?

No one should be above the law - EVERYONE says that (even as it is manifestly untrue). However, “equal justice under law” also means that no one should be BELOW the law - meaning that someone should not be denied Due Process rights because they are rich and/or powerful.

No, that’s way too small of a perspective. What they’re doing in the House is a danger, not just to the Presidency, but to our very judicial system. This is the imposition of a Star Chamber on our judicial system - hearsay on hearsay being presented as evidence, key supposed witnesses forbidden to appear, preventing the cross-examination of other key witnesses and, above all, the secrecy (under the guise of “national security” - which every single person knows is a bunch of hooey in this particular case).

What we have here is a bunch of State Dept. and intelligence community EMPLOYEES trying to bring down the duly-elected President of the United States for the sole reason that they don’t like him or his policies, and they ESPECIALLY don’t like that they weren’t listened to and were (banish the thought!) circumvented by the use of special envoys (as if no other President has done that - when virtually ALL of them have since WW1 or even earlier). This is a coup - and it is being aided and abetted by bald-faced liars like Schiff and a Speaker of the House with what appears to be a tenuous hold on reality.

People need to go to prison, or swing from a gallows, for this attempt to circumvent the will of the American people.

Since what would occur in the Senate is a trial, I believe that Trump is able to call ANYONE as a witness, without restrictions, to prove his end of the case. These people should ALL be called.

As for Ciaramella, he need not EVER be asked if he was the “whistle blower.” It is too easy to ask him about all of the background questions surrounding this incident, the answers to which will frame him as the whistle blower by virtue of the information that was already released by the Dems regarding the WB. Further, he can be specifically asked if he ever met with Schiff, and on what dates. It’ll blow the case wide open, especially when his attorney is called to the stand (yeah, him, too) - the attorney who wanted a coup to begin the moment Trump was elected. That ratphuck needs to be exposed, and an ethics complaint filed against him if there is a shred of evidence of unethical behavior.

Even the Washington Compost gave Schiff 4 Pinocchios for lying about his contacts with the WB before the WB filed his complaint. If those clowns can find out this information, so can the US Congress and its investigators.

There must be some procedure available for the House to impeach the President and then never actually refer those charges to the Senate.

There is, but the timing does not favor the Democrat strategy.

The procedure would be to vote to impeach in the late stages of the Congressional session (say, October 2020 before the election), hoping that the October Surprise is enough to keep Trump from winning. Then the Democrats would delay the Senate (which would likely go into recess until after Thanksgiving) until it adjourns sine die at the end of the year, claiming a lame duck Senate shouldn't hold a trial on a President who just faced the voters.

By adjourning sine die, all business before the Senate would be deemed completed, and the articles of impeachment will expire with all other pending legislation. If Trump wins reelection in November 2020, the next House would have to start all over in January 2021.

I think your example would be exempted by the felony exclusion.

If another Congressman claimed immunity from testifying to a murder, he would be charged as an accessory to murder, or aiding and abetting.

To your first point, I'd argue that what Schiff knew is a product of his office, and so would be privileged. He only knew it because of what he was working on.

Of course, if he was working on treason then his privilege would be gone, but nobody is going to go there.

Testify, or your case is summarily dismissed.

I'd love to see that happen, but I don't think that Graham has it in him to bluff like that.

I say "bluff" because I doubt that the Senate has the votes to go through with a summary dismissal.

This isn't a 6th amendment trial. Trump will only be allowed to call what the Senators negotiated as allowable to be called.

I do not believe we have ever, in American History, been in a destructive scenario quite like this.

Again, thank you left wing Democrats.

We literally have current House members (almost an entire party) intricately involved in every aspect and detail, of a real effort to manufacture purely false “evidence”, by way of encouraging and providing cover for numerous actual illegalities (violations of both regulations and law) within the IC, in conjunction with both “friendly” and “hostile” foreign governments, to remove a Constitutionally elected POTUS, who absolutely loves this country.

And they are doing all of it ultimately with the GOAL of replacing our Constitutional Republic, (and individual liberty derived from it), with a system which erases our borders, and subjugates us, and forces us to pay for global socialist governance!

In a just and honest world, this alone should be enough for a number of quick executions.

This is easily the worst Constitutional crisis in my lifetime, and it involves both large scale “principled treason” and “sedition”, being carried out by multiple socialist members of Congress working together with left wing socialist members of the IC, (who possess the same globalist goals), all secretly working out plans involving foreign governments, and many tens of millions of dollars! In reality, billions.

Generalising here, as many on FR have, I have loved and studied American History throughout my life.

There have been numerous crisis’s, as well as several damaging compromises made with the left, involving our Constitution. The Civil War nearly ended us in different ways.

However, apart from the lead up to the Civil War, we have never had an entire party, using their congressional seats, so dedicated to the destruction of the U.S. Constitution, and overthrow of our government, with the goal of replacing it with a formal centrally controlled socialized state, and fully and illegally utilizing our highest “police” (IC and DOJ) powers, simultaneously working with multiple foreign powers, with secret money and deals being made to carry it out!

On this scale, this really is new crisis territory, on an unbelievably destructive scale.

And the left has again, brought us this real very real crisis.

The no-moral-boundaries, anti-American, socialist Demorats know well the passivist “Republican Rules of Engagement”, and have long used them to advance and execute their left wing overthrow of the Executive Branch, as well as to carry out their subjugation of American society, and global socialist objectives.

Because no one on the right wants conflict, or an interruption to economy (paycheck), and no one wants real civil war, even now, the gravity and depth of this crisis is being hushed to a great degree, and the crisis intentionally deepened and widened by all entities on the left, with the lifeblood of the left wing socialist being their mass media machine.

‘IF’ there even is a way to really fix this, it is absolutely going to need many high level prosecutions, to include current congressman, period. The only way this can happen is with them being removed from office first. The Legislative Branch can do this, but are highly unlikely to do so, because they do not love our Constitution and America, more than they love their own influencial and lucrative positions.

Because the no-moral-boundaries, anti-American, left wing will not stop, and we are not willing to bring justice to them, our Constitution, nation (as we know it), and our liberty are done. Uncorrected, it appears this crisis is the threashold, from which we really will not be able to formally come back from.

If real justice and law are not defended here and now, with prejudice, the president is set, and we as citizens lose our ability to determine our representation, future direction of our lives, and our liberty.

Unfortunately, if Mitch, Lindsey, the Republican Party, and Roberts play games and let this go, we really will be fortunate to have a civil war, where our Constitution and liberty may somehow still exist in a bulkenized country.

So, Representative Adam SCIF now claims he does not know the name of the whistle-blower. Yet, if Eric Ciaramella’s name comes up in the hearings, Liddle Adam will shut down the hearings and sanction any Representative uttering the name Eric Ciaramella. So Liddle Adam MUST know the name of the whistle-blower! Otherwise, how would he know when to object? Case closed. Adam SCIF is a liar!
