MILWAUKEE — A federal appeals court has affirmed a lower court ruling that Republican state lawmakers can't intervene in a Planned Parenthood lawsuit challenging certain Wisconsin abortion restrictions.

The Milwaukee Journal Sentinel reports that Thursday's ruling from the 7th Circuit Court of Appeals leaves it up to Democratic state Attorney General John Kaul to defend Wisconsin's abortion laws.

Republican lawmakers don't trust Kaul because he has supported abortion rights before and was endorsed by Planned Parenthood last year.

The appeals court backed a ruling from federal Judge Willian Conley, who said Republicans hadn't come close to showing that Kaul would shirk his duties.

Oh - like California?!

But I bet if Trump was in charge they’d be summarily deciding against Planned Parenthood and throwing the case out - but since it’s a Democrat and an actual LAW the judges will just let the case lapse.

Original "decision" by William Conley, 0bama appointee (99-0) and Chief Judge of the United States District Court for the Western District of Wisconsin.

Three judge panel from the Seventh Circuit Court of Appeals:

Opinion was 3-0.

Conley is Resistance:

On March 10, 2017, Conley granted a request blocking President Donald Trump's administration from enforcing its newly revised travel ban against a Syrian family from the city of Aleppo, saying that daily threats against the man's wife and child could cause "irreparable harm". The ruling was the first of its kind since the roll out of the second executive order.
