Judge strikes down Trump rule on health care 'conscience' rights

A federal judge in New York on Wednesday struck down a Trump administration rule that would make it easier for health care providers to refuse to perform services, such as abortions, that conflict with their religious beliefs.

District Judge Paul Engelmayer invalidated the rule on multiple grounds, including a finding that it violated the Constitution’s spending clause by allowing the administration to cut off funds approved by Congress to providers who do not comply with the rule by forcing employees to perform services to which they object.

A number of states, including New York, as well as Planned Parenthood and other groups had sued over the rule, which was scheduled to go into effect on Nov. 22.

They argued the rule would allow for discrimination in the name of religious freedom.

“Today’s decision is an important victory against the Trump Administration’s cruel and unlawful attempts to roll back critical patient protections,” Alexa Kolbi-Molinas, an attorney with the American Civil Liberties Union, said in a statement. “Everyone is entitled to their religious beliefs, but religious beliefs do not include a license to discriminate, to deny essential care, or to cause harm to others.”

The Trump administration had touted the rule as important protection for people’s religious beliefs, specifically citing abortion.

“This rule ensures that healthcare entities and professionals won’t be bullied out of the health care field because they decline to participate in actions that violate their conscience, including the taking of human life,” Department of Health and Human Services official Roger Severino said when the rule was proposed in May.

The these judges strike down anything Trump wants to do. He should issue exec orders for open boarders, declaring RATS win all elections, and free abortions and sex changes.

Freedom of religion is in the Constitution. It says nothing about "discrimination", which is open to personal interpretation.

Any one of these clowns are empowered to stymie the President’s lawful exec orders?

Don’t worry. Congress has all the Article III authority it needs to deal with judicial tyranny . . . any day now . . .

It’s a two-edged sword. We start letting a physician act on his/her “conscience” or religion, then it becomes a very slippery slope.

We need to be very careful what/how we ask for this because then we may get it - but there may be unintended consequences.

There are some misogynistic cultures out there that don’t believe in a woman’s right for medical care without the permission of a man - her husband, brother or father. If she has no man, the physician will deny care quietly, under the radar, let her die (this actually happened to my mother until we “stole” her from their so-called care).

There are other cultures out there that permit female genital mutilation and think nothing of it. Michigan, anyone?

There are cultures out there that deny patients care due to race, ethnicity, age, sex, religion, insurance company, demographics.

This is all happening right now within the borders of the USA and they are acting within their individual beliefs and “conscience” - or even lack of it.

If you disagree, look at the H1B1 visas and how the misuse of this program has harmed our own LEGAL American Citizens in several industries in addition to the harm caused by the off-shoring of our personal, medical & financial data, putting thousands out of work and exposing hundreds of thousands to identity theft & fraud.

No, we don’t want any physician working on us who doesn’t want to do it, but if & when we are alone or unable to make decisions for ourselves, we don’t have a choice. We rely on others to take on our medical care and pray they actually see us compassionately as a human as opposed to a political or religious enemy and that they remember the first rule of American medicine: “Primum non nocere” (first, do no harm) because their conscience demands otherwise.

“Discrimination” is a value judgment of good or bad, better or worse, acceptable or not. One may discriminate on one brand of coffee or another, price for value, right or wrong, or any of thousands of evaluations. Protestant or Catholic is discrimination. Christian or Pagan is discrimination. Republican or Democrat support is discrimination. This judge agrees that people may not have religious freedom.
