One of President Trump's nominees for the Ninth Circuit Court of Appeals broke down in tears during a Senate Judiciary Committee hearing Wednesday, as he disputed suggestions that he would not be fair to members of the LGBTQ community.
Lawrence VanDyke was the subject of a scathing letter from the American Bar Association, sent to committee leadership Tuesday night, which alleged that people they interviewed expressed this concern, and that VanDyke himself "would not say affirmatively that he would be fair to any litigant before him, notably members of the LGBTQ community."
But conservatives have adamantly defended the nominee. And when asked about this at Wednesday's hearing, VanDyke strongly disputed the ABA's account.
"I did not say that," VanDyke told Sen. Josh Hawley, R-Mo., tears welling up in his eyes.
"No, I did not say that. I do not believe that. It is a fundamental belief of mine that all people are created in the image of God. They should all be treated with dignity and respect, senator," he added, sobbing.
VanDyke also said that he was not given a fair opportunity to respond to the allegations during his ABA interview. He said when he was confronted with the concerns about his views, he began to answer but was told they were running out of time.
That interview was conducted by Marcia Davenport, the lead evaluator. Hawley noted that Davenport once contributed to the campaign of a judicial candidate who was running against VanDyke.
"I find that absolutely unbelievable," Hawley said, stating it "probably explains the totally ad hominem nature of this disgraceful letter."
The paragraph preceding the questioning of his attitude toward LGBTQ litigants included a list of other complaints against VanDyke, attributed to "the assessments of interviewees," without detailing who or how many.

I hate to make a snap judgment, but if this brings you to tears instead of just making you mad, you probably are not conservative enough to be a good strong judge.
Since graduating law school [Van Dyke] has been a member of the Federalist Society.
VanDyke was born on December 12, 1972 in Midland, Texas. The following year, his family moved to Bozeman, Montana.
VanDyke earned his Bachelor of Science, with highest honors, from Montana State University in 1997 and a Master of Arts in 2000.
He received his Juris Doctor, magna cum laude, from Harvard Law School, where he was an editor of the Harvard Law Review.
After graduating from law school, VanDyke served as a law clerk to Judge Janice Rogers Brown of the United States Court of Appeals for the District of Columbia Circuit. He then worked in private practice at Gibson, Dunn & Crutcher.
From 20122013, he was an Assistant Solicitor General of Texas. He served as Solicitor General of Montana from 20132014, when he resigned to unsuccessfully run for the Montana Supreme Court.
He became Solicitor General of Nevada under Attorney General Adam Laxalt in 2015, where he served until 2019.
In 2019, VanDyke became a deputy Assistant Attorney General for the United States Department of Justice Environment and Natural Resources Division, where he currently works.

The Lefty court-packers are still just recovering from the Trump flash-bang of 2016.
Now, they're starting to panic after they realized that Trump is packing the courts with Federalist Society members.
VanDyke is on OUR team, and he's getting smeared by the same pros that smeared Kavanaugh.

Perfectly normal reaction. Some people uncontrollably smile or grimace given an emotional or intensse situation. I hate that I often will smile when challanged. Can’t help it. Seems inappropriate.
They very well may have been tears of anger and frustration at not being given the chance to defend himself when put before the group that wrote that attack.
