Pelosi’s deceptive ‘impeachment vote’

Speaker Pelosi is playing word games, trying to pull a fast one on the Republicans, the American people, and the Constitution by appearing to “authorize” a formal impeachment inquiry, while not actually passing an impeachment resolution that would trigger rights for Republican House members to call witnesses and issue subpoenas.

That is why, when ambushed by NBC News, she was careful to make a distinction and say “It is not an impeachment resolution.” It was a walk-by comment:

Speaker Pelosi is holding a vote, a resolution, to affirm her previous declaration of a House “inquiry”…. Pelosi is not delivering a House “Resolution on Impeachment” for a vote, because if she did hold a vote on an impeachment resolution, the minority and the Executive branch would gain rights therein.

Note that the final wording of the resolution is not yet available

The rules for an “impeachment investigation” would provide rights for the minority and also rights for the Executive branch.

So instead of having a House vote to authorize an impeachment investigation, with subsequent rights for the minority; they are having a House vote to affirm the “impeachment inquiry” with an entirely different set of House rules that do not include rights for the minority.

Nice trick huh?

Queen Pelosi and Shifty king Schiff are attempting via resolution to legitimize a body of Kangaroo Court evidence, which actually is an attempt to draft a Bill of Attainder against President Trump under color of impeachment.

Bills of Attainder are specifically prohibited by Article 1, clause 3 of the Constitution whether defacto or dejure.

Queen Pelosi and Shifty King Schiff are about to experience the political equivalent of the enactment of the French Revolution.

Pelosi is evil, and I don’t use that word lightly. She will manage to say that impeachment was “deemed” to be passed as a result of this BS.

Pelosi will never give the Republicans the power to subpoena her son Paul and force him to testify under oath. From 2014-2017 the Ukraine was used by the Democrats as their prosecutor free corruption zone. Paul Pelosi, like Hunter Biden , had absolutely no expertise in energy matters. Yet like Biden , he sat on the “board” of a Ukrainian energy company ad was paid hundreds of thousands of dollars. Schiff himself benefitted from a fund raiser given by Ukrainians. The Republicans have keep howling and point out what Pelosi is doing to protect her son and other corrupt Democrats.

So they’re voting to approve/disapprove all the crap Shiff did already? And she is hoping enough on her side vote no, to kill the impeachment in it’s infancy, so she can escape any more embarrassment from it all. If that’s what she wants, she should still have a few far left moderates to help her on her side of the aisle.

Currently the Legislative Branch is expressing their “impeachment authority” as part of the Legislative Branch purpose.

So that raises the issue of an entirely different type of subpoena: A demand from congress that penetrates the constitutional separation of powers and
further penetrates the legal authority of Executive Branch executive privilege.


POINTS TO PONDER
It was separately established by SCOTUS during the Nixon impeachment investigation that
*IF* the full House votes to have the Judiciary Committee commence an impeachment investigation,
then the Judiciary Committee has subpoena power that can overcome executive privilege claims.

<><> There has been NO VOTE to create that level of subpoena power.
<><> ergo, the House has not created a process to penetrate the constitutionally inherent separation of powers,
<><> nor the legally recognized firewall known as ‘executive privilege’.
<><> a House vote authorizes the committee impeachment investigation,
<><> only then does the committee gains judicial enforcement authority.
<><> thus creating the penalty for non-compliance with an impeachment subpoena.


A demand letter only becomes a “subpoena” (technically ‘a request for the production of documents with a penalty for non-compliance’) when the committee has judicial enforcement authority.

Only then does that process establish an enforcement penalty.

The current demand letters cannot carry a penalty because the demands do not contain judicial enforcement authority....simply because the impeachment investigation was not authorized by the chamber.

The reason judicial enforcement authority is constitutionally required is because creating Judicial enforcement authority, creating the penalty for non-compliance, gives the Executive Branch a process to appeal any legislative demand via the Judicial Branch (federal courts).

Absent a penalty for non-compliance, which factually makes a subpoena a ‘subpoena’, the Executive Branch has no process to engage an appellate review by federal courts.

This, then, is the purposeful trick within the Pelosi/Lawfare road-map.

Dems are like dead men walking. What’s become apparent is that Democrats are so desperate for power AND control,
they have no idea that voting America waiting for the next Trump rally can smell them miles away.

In the Democrats’ rancid world, they keep saying “words”, that they hope will wound a president they despise.

The Dems will savagely strip innocent patriots of their rights in order to feel the thrill of controlling people.

For the Dem left, a little crotch action will always supersede the Constitution.

Patriots know these sub-human morons will stoop to any lengths and will regurgitate the most preposterous lies to advance their pathetic political ambitions.

The left fights hard for “rights” not even mentioned in the Constitution – abortion, health care, a “free” college education – than those intrinsic rights specifically singled out for protection from government infringement in the Bill of Rights.

Lefties are desperate for power. Desperate Democrats badly crave power AND control, and they’re willing to do anything to get it.
