State agrees to suppress some information in Mollie Tibbett's trial

The state has agreed that some statements from the man accused of killing Mollie Tibbetts should not be used in court.

In August, Cristhian Bahena Rivera's lawyers filed a motion to suppress information gathered during the police's investigation. They claimed that Rivera's Miranda rights were violated and, therefore, some of the information gathered during his interview should be removed from court proceedings.

On Friday, the state responded, saying, in part, "This resistance includes some new facts that were not relevant to the arguments the Defendant made previously and reflects additional information unearthed in ongoing discovery," according to court documents.

The state conceded that the initial Miranda warning was incomplete but said the second warning was valid. Therefore, comments made between the two Miranda warnings should be suppressed, according to the state's filings.

The state claims it should be able to use any evidence found in the vehicle, any information it gathered from Rivera after its agents arrived on the farm where Tibbetts was found and any evidence gathered from the incomplete statement, despite the claim of Rivera's Miranda rights being violated.

The state remains certain that Rivera's statements were voluntary and that his rights were not violated.

The judge is hosting a motion to suppress hearing at the Poweshiek County Courthouse from Tuesday through Thursday.

Is the family still supportive of the perp, not wanting his crime to affect immigrant “rights?”

They feel pious about offering Mollie as a human sacrifice to their gods.

Looks like our two tier justice system now protects illegals.

Mollie’s wackadoodle lib mama gave the murderer’s illegal alien cousin her empty bedroom.

The Democrats in general and especially local politicians have protected them but I don’t think the courts have until recently. I may be wrong as I have been wrong occasionally.

FWIW Iowa abolished the death penalty in 1965.

The last I heard, which was some time ago, was that they were shockingly indifferent to the perp, and that some others came out in support of him.

How sad that Mollie has such despicable family and even strangers have dismissed her death. One can only speculate that these people have something to hide.

He’s an illegal alien, not a citizen. What rights does he have?

Keep in mind that the Tibbetts family is from San Francisco, CA.

IIRC,they had a prior relationship with the perp’s female relative, who was hosting him. They didn’t want his murder to completely spoil their relationship with her.

For me, even if the relative had nothing to do with the murder, I wouldn’t be able to look at her, and wouldn’t have anything to do with her. Too many memories. Righteous behavior be damned.

They sound like the types who would praise Charles Manson for his leadership abilities and admire Jeffrey Dahmer’s “culinary skills”. Wouldn’t surprise me if they dismissed Shitler’s atrocities, he was a vegetarian who cared about the environment. How detached can these fools get?
