There was no “accident”.
The possibility of an “accident” ended completely when donutwatch snuck around the house without announcing himself.
The officer had no legal right to trespass on private property. As noted elsewhere on this thread, the police were asked to check on the welfare of a resident, nothing more. There are procedures they must follow before they can enter private property, which they failed to follow in this case.
The officer took it upon himself to draw his weapon, and enter private property without probable cause that a crime was being committed. He therefore committed a criminal act in the State of Texas. Then, while committing a crime, killed a citizen who was lawfully in their own home.
That is murder.
From what I saw of the unedited full bodycam vid before it got pulled down off YouTube for terms violations, they never rang the bell, knocked on the door, didn’t ever call out.
It really is looking like the only failure was that of the officers. Well - the officers *and* their training and command.
Plain, and the burning, now carbonized, bagel had not yet had toppings or spreads applied.
This was murder, pure and simple. The cop trespassed, snuck around with gun drawn, and murdered the homeowner. There is no defense. That he was a police officer is no defense. That she was black woman is no defense. He committed murder.
Indeed, he IS special.
I called the police because when I got to my Mom’s house her front door was wide open. This was at 10 in the morning and she was in the hospital. They told me don’t go inside just wait for us. When they got there they knocked on the doorjamb and said....anybody in there? They had their hand on their gun but it wasn’t drawn. The burglars were long gone. Pretty sure that’s the way it’s supposed to be done.

I have read the comments on this tread it has many strange comments, never saw so many Jailhouse Lawyer Comments..... the whole episode could have been avoided if the cop had just done what the Parkland School Cop did, just stay under cover in the car and stop trying to do your duty. Isn’t that what we pay cops to do..If they get out of the car....They should JUST TAKE THE BULLET WITHOUT COMPLAINT?/S

I think it was murder. If I saw somebody flashing a light into my house at 0230 I would assume the worst and grab a gun too. I don’t need to be shot by some policemen who is too unprofessional to positively announce and identify himself. I wonder if he’ll more time than the female Dallas cop who murdered a guy eating ice cream on his own couch?
Geeeeee, you’d think the very first thing that would be reported was she pointed a gun at the cop. IF THAT WERE TRUE. Instead the very first thing reported was that she was unarmed...

If the woman actually had a gun, and was pointing it at the window, then she was protecting herself from an unknown intruder. It would be like anyone else, perhaps a burglar, encroaching into into this woman’s back yard at night. She has a right to defend herself. The cop had no right to be there unannounced.
I wouldn't be certain she ever possessed the gun in her entire life, legally or illegally.
If you watched the video, nothing was ever announced, the idiot officer was sneaking around the garage with a flashlight. If it happened at my house, I would have had a gun out!
What kind of an idiot goes on a wellness check and doesn’t knock on the damn door and go wandering around the garage with a flashlight at 2am and doesn’t expect to get shot?

I personally do not doubt that she had a gun, especially a single woman in that area (most cops’ advice for lone women in similar situations here is “get a gun, learn how to use it). I also think it is completely irrelevant both morally and in regards to state law. She was doing nothing wrong, fully within the law, and I suspect that it is probable the cop would have shot her if there was anything in her hand. Phone, camera, gun - doesn’t matter, this guy was amped up.
